If you noticed the guy was in the middle of car traffic, that is the officers concern, as well as the privacy of the person dealing with the arrest. This guy had every right to film this situation but didn't have the right to get inside the officers space. It is not illegal to post stuff like this on you tube or you tube wouldn't exist. Also the news would have to get everyone's permission to post there stuff.

  • He wan't really arrested for filming he was arrested for impeding an officer in his duties, When the officer said it was too close he should have backed off. The officer didn't have a problem with him filming he even said go over by the carts. This guy was walking up to the situation the cops were dealing with. Cops don't like it when people they don't know walk up to them when they are performing their duties. It is not illegal to post pics or video of people on the internet.

  • @anainutta You stand behind an officer it is very concerning when you need to have your attention drawn to the person you are talking to. He was TOO close. If the officers were concerned about the video they would not have asked him step further back. They would have said stop taping. The one piece of fact I must share is the video taper has a history of assaults on peace officers and interfering in investigations. Try looking up 148 (a)(1) pc of the California penal code.

It's perfectly legal to record ANYTHING in public, even fights etc (though it may be confiscated as evidence), you just don't have the rights to upload or display them without consent. Whether the person finds it online and prosecutes you is another matter entirely, so most people get away with it. This guy, however, also followed the officers (harassment)

The violation here is posting it to a public access channel (the internet) without consent, the footage obtained was done so during a crime (harassment 2nd), making it confiscateable. You are NOT allowed to POST video footage of someone without consent, you're only allowed to record it. They can bring a civil suit (as many have) as well as the above mentioned criminal charges. Call a lawyer, ask for yourself. That person's likeness is what makes it so.

  • @Pafoofnik1 And I gave you a VERY SPECIFIC law regarding this incident. It is harassment 2nd degree, as well as obstruction of justice as the officers were issuing a citation. He interfered with the investigation and followed them repeatedly. Posting it online without consent is grounds for a civil suit, because their likenesses become "intellectual property" and thus, it's illegal. I don't know how much more clearly you want me to explain this to you, it's pretty simple.

    Transparency in government includes filming police on duty. The man looked to be about 15 feet or more away. Imagine the outcome of the Rodney King beating trial without the video.

Beyond that, what about the woman's right to privacy the camera man violated. You could here on the recording that she didn't want her picture taken or any video filmed? They put her in the car because she was about to go after him.

    Not if it's open/available to the general public...unless the owner arrived and requested a departure or cessation of filming by the cameraman. In that event, he would have to stop or leave to avoid charges of trespass. But simply taking photos in, say, a shopping mall, isn't a violation in itself unless directed as above. The cops were not the owners and appeared to be acting in some other capacity.

This all White German unit ( 100 officers) roamed the hot spots in undercover cars with 3 officers. They were the elite of the force and tough. Blacks were terrified of them. That constitutes harassment 2nd degree, Scroll down to my previous comments and there's a link to a page (a government page) with the description of the crime, as well as obstruction and interfering with an investigation (also the local municipality regarding officer safety during said investigation/issuance of citation). Pretty simple stuff, the guy deserved to be arrested. He brought it on himself.

    There are stipulations. In some states you can not record someone in private... however in public it's fair-game, as there is a general rule/law that gives no expectations to privacy, while in public.

  • anytime you are in public you have no legal expectation of privacy- so audio is allowed to be recorded- you are watching someone videotape you that is implied consent for audio recording- the police DO NOT HAVE THE RIGHT TO ARREST THIS PERSON. It is unlawful detainment; violation of 1st and 4Th Amendments at minimum., WAKE UP AMERICA!
