1. Why would you be able to pick it up if it wasn't?

2. Rockstar made both games.

3. It's a fucking cowboy hat in a Los Angeles trash can in a crime scene!

If it were found during the traffic case at the Hollywood set and prop houses, then it wouldn't be an easter egg. The fact that it is SO out of place (in an alleyway at a crime scene in downtown Los Angeles) means that it probably IS an easter egg. Why is this an issue?

Jack Marston (assuming he didn't serve and die in WW1 or WW2) would still be alive. In 1914 (the epilogue of RDR) Jack was about 18. So in 1947 Jack would be around 51.

They don't necessarily have to be identical or nearly identical to each other to be sequels, just carry the same name apparently. A spiritual successor would be more like System Shock to Bioshock and Demon's Souls to Dark Souls. Red Dead Redemption is considered a sequel, maybe not to you, but it is officially recognized as one.
