The only actions that constitute a crime are those causing harm or loss - everything else is only a contravention of a legal rule that a legislative body has invented. This is the problem with our countries today - our legislators have no principles and therefore can be manipulated by those groups with an agenda to make certain actions "illegal".
If the Congressman had a preconceived value judgement (general principle) about every crime (regardless of the specific sensitivities in society) that would mean he could be judgemental without considering the circumstances of a specific crime.
Moreover, by not having a principle, he would be better off (with you) by saying he based his principle on information from his constituents on the ground. That would complete his answer and settle it quite delicately.
