Prop 22 was passed in 2000, not 2004, by 61% of voters in a primary, March, election with a 50% voter turnout. That was just 32% of registered voters, and 19% of all adults in the state ("the people of California") as you say.

November 2008 is a major election. I'm sure voters this time will let people make a personal choice in their lives of who they marry, just like the Constitutionally protected personal choice of religion. Both sides lose nothing, by leaving the Constitution alone.
