This is the system of checks and balances set up by the Founding Fathers. Lawmaking is not a popularity contest like American Idol. It is the responsibility of the judiciary to see that laws do not violate constitutional rights, as Prop 8 does. If you disagree, make your best legal argument, but emotional arguments won't work.

This is the system of checks and balances set up by the Founding Fathers. Lawmaking is not a popularity contest like American Idol. It is the responsibility of the judiciary to see that laws do not violate constitutional rights, as Prop 8 does. If you disagree, make your best legal argument, but emotional arguments won't work.

Not everything in history is right or just. Gay people have been getting married since prehistory. The time has come for the US government to recognize that fact. The tide of history can't be stopped. Homophobes haven't the moral fortitude to see this fight through. But gays do.

Both of your arguments are flawed. First, only about 10% of the population is gay. That isn't going to have an impact on the population. In fact, you can argue that it serves a necessary function bu controlling the population. There are more people alive today than the total number of people who ever died. Second, NOBODY has the right to deny the constitutional rights of others, even if they have a majority.

Anti-gay religious bigots are the ones who tried to "change the definition of marriage," though it has backfired on them badly, as now the unconstitutional Prop 8 will be used as a precedent to overturn all anti-gay marriage laws nationwide. Bruning, it dealt with a federal 8th circuit court OVERRULING a lower district court ruling that somehow there was no rational basis under the equal protection of the 14th amendment to deny gay marriage in an attempt to overturn the people's vote.The higher court reversed that decision to criticize the judge's fallacious ruling and explained exactly why there is rational basis. which means this case means nothing in the grand scheme of things

In this clip, one of the panelists mentions towards the end of the clip that marriage between a man and a woman is better and that there is great evidence to support this. However, if you read the decision, only two experts were presented for the defense of Prop 8 and they were totally discredited. I say to read the decision yourself and see if you still agree with these panelists or with the judge.

I find it difficult to understand how a man or woman in a 'traditional' marriage --with children--can cheat on their spouse, get a divorce, shuffle the kids between them get married a second or third time to someone else and their relationship (s) still be seen as better than same sex marriage. If we all pay taxes, we all deserve the same (no more or less) benefits and responsibilities. Equal protection under the law is what made this country great. Why question it after 200+ years?

FYI: The anti-miscegenation laws actually recognized the natural teology of marriage and the family; so much so that they sought to use the law as a eugenics weapon to prevent certain types of people from being born.
Virginia's Appeal court said the laws were meant to prevent "a mongrel breed of citizens," and "the obliteration of racial pride."
