Agents can of course respond to plain view evidence of other criminal activity but they can't actively seek out such activity as part of the checkpoint's scope.
Poor Patc170, still can't grasp basic facts regarding the limits of these agent's lawful authority. Agents need either consent or probable cause to extend a detention here. The Supreme Court made that abundantly clear in U.S. V Ortiz & U.S. Martinez-Fuerte. Since they had neither in this case, their extended detention was unlawful.

Further, the U.S. Supreme Court has explicitly acknowledged that certain aspects of cases such as Terry V Ohio, which were city or state level, apply at these checkpoints as well. The BP agents are breaking the law as soon as they ask ANY other question besides Citizenship.
Plus, numerous cases on the 5th Amendment state very clearly that even though a cop can ask you questions, you are under NO legal obligation to answer those questions, and it doesn't matter if the cop doesn't like it.

If they refuse to answer, then obviously citizenship still needs to be verified, with or without probable cause. Because someone refuses to answer a question doesnt mean BP loses its authority to make a brief immigration query. There was nothing illegal about the agents actions. Maybe you should understand the law a little better before commenting.

@f22alphabravo He's NOT allowed to ask who owns the vehicle, who the vehicle is registered to, they are ONLY allowed to ask citizenship, PERIOD.
As soon as that agent ask ANY other question, he violated the law, and the fact that they got it on video means it can and will be used in court against that officer.
Long term checkpoints are USELESS to catch illegals or drug runners, the longer the checkpoint stays in one place, the less likely they are to catch any illegals or drug runners.
