Clearly, Ersland didn't feel his life was in danger by that kid. I can tell you how I would have reacted - and a normal person - if I felt that threatened by that kid's presence even after the kid was shot. Ersland had every opportunity to leave the area. Or when he went back to retrieve a gun after he already shot the kid. Why did he come back to shoot the kid again? Why didn't he hide? Why didn't he call 911? It was murder. The DA did right.

It all comes down to this: deadly force is ONLY justified to defend immediate danger to life or limb. Once the kid with the gun ran away, there was no justification for deadly force, especially with HIM going outside in pursuit of the kid who had the gun as though he certainly wasn't afraid of anything.

The DA might the right decision. Personally, I would have done whatever I could have to just hand the robbers what they wanted and void any kind of shootout. His first mistake was getting a gun to shoot back. That may sound cowardly, I would just call that being smart. My guess is if he had just given them money, they would have left. The video shows he's not guilty. All of the evidence shows that he had legitimate reason to believe Parker was playing possum and getting ready to shoot.
If you're under life-threatening duress, you cannot be held accountable for actions you believe to be in your defense to the extent of 1st degree murder. The video shows duress. The fact that the judge and the DA blocked that defense, which the law and Constitution uphold, suggests that they need to be behind bars.

His back isn't turned until he knows Parker is either dead or definitely incapacitated. Until then, Parker was a threat because he could have been armed. Read the coroner's report. At least one of Parker's movements looked threatening.
It'll be time for Ersland to be released, get that boy's mother's assets, and get the judge and DA thrown behind bars soon enough.

I understand the other side now that I saw the other footage, but I think you're underestimating the possible psychological impact of the armed robbery. The back turn can be explained by any number of things because Ersland did know the Parker couldn't see him until he popped his head. Someone playing dead face down doesn't see their target until they pop their head so Ersland could have simply been rushing to get the second gun.
The law has been changed so it looks like Ersland will probably walk in a couple of years once the pardon and parole board hears it for better or worse.
It's possible that Parker was completely innocent, but if he was, Ersland had no way of knowing that. Once a person is helping someone who's shooting at you without provocation, it's reasonable for you to assume he's armed and dangerous until he's dead or has fled.
Robbers have a VERY LONG HISTORY of playing dead when the law says it's murder to shoot someone lying down. They often fire deadly shots from the ground. The James-Younger gang is said to have employed it.
This case looks more and more like temporary insanity on Ersland, which is a legal defense. The prosecutors said he was "out of touch with reality" and so forth. I don't know what the punishment is for murder by temporary insanity, but it's definitely a defense since the being shot at can clearly make someone go insane.

Clearly, Ersland didn't feel his life was in danger by that kid. I can tell you how I would have reacted - and a normal person - if I felt that threatened by that kid's presence even after the kid was shot. Ersland had every opportunity to leave the area. Or when he went back to retrieve a gun after he already shot the kid. Why did he come back to shoot the kid again? Why didn't he hide? Why didn't he call 911? It was murder. The DA did right.

It all comes down to this: deadly force is ONLY justified to defend immediate danger to life or limb. The DA might the right decision. Personally, I would have done whatever I could have to just hand the robbers what they wanted and void any kind of shootout. His first mistake was getting a gun to shoot back. That may sound cowardly, I would just call that being smart. My guess is if he had just given them money, they would have left. But notice something. When he went to retrieve his gun after he already shot the one kid, he was walking calmly with his back to the kid. He didn't show fear.

If you're under life-threatening duress, you cannot be held accountable for actions you believe to be in your defense to the extent of 1st degree murder. The video shows duress. The fact that the judge and the DA blocked that defense, which the law and Constitution uphold, suggests that they need to be behind bars.

There's all of the evidence in the world that he didn't have sufficient time to cool off. The jury said he "acted irrationally" and convicted him of first degree murder. That's a contradiction which shows that they weren't instructed properly. Since Ray Elliott has a lengthy history of jury tampering, he is to blame.

His back isn't turned until he knows Parker is either dead or definitely incapacitated. Until then, Parker was a threat because he could have been armed. Read the coroner's report. At least one of Parker's movements looked threatening.

I understand the other side now that I saw the other footage, but I think you're underestimating the possible psychological impact of the armed robbery. The back turn can be explained by any number of things because Ersland did know the Parker couldn't see him until he popped his head. Someone playing dead face down doesn't see their target until they pop their head so Ersland could have simply been rushing to get the second gun.

It's possible that Parker was completely innocent, but if he was, Ersland had no way of knowing that. Once a person is helping someone who's shooting at you without provocation, it's reasonable for you to assume he's armed and dangerous until he's dead or has fled.
Robbers have a VERY LONG HISTORY of playing dead when the law says it's murder to shoot someone lying down. They often fire deadly shots from the ground. The James-Younger gang is said to have employed it.

But since he waited, deliberately changed guns, and shot a man on the ground 5 times before calling police, when he clearly had no concern for his safety (as @AZRanger put it well), that shows premeditation and a blatant disregard for human life that would make any sane person find him guilty of murder.

Antwun (Speedy) Parker was a large and powerful man that was still moving on the floor. Yes, but life in prison? You got to be out of your damn mind. Basically the courts finished where the robbers left off. They concluded the destruction of an innocent life.

@Mega554321 He wasn't defending himself - that's why he got life. The first shot to the boy's head was self-defense. If he'd have stopped there, he'd be a free man right now. He didn't. He chose to calmly step over the boy who was lying face down in a pool of his own blood - slowly dying from a bullet wound in his brain, go and retrieve another gun, come back, stand over the incapacitated boy, and calmly shoot him 5 more times in the back. That's an execution - not self-defense. That's murder.

I do agree that he should of stoped there but like i said he might have been caught in the moment, and he most likely would of died by the headshot or at least disabled in some way. The supreme court should clarify on what is self defense, should a person stop when the criminal is subdued or stop when he feels he is safe?

It's very frustrating, to hear about law abiding people getting imprisoned for defending themselves. Things like this put the power in the hands of the criminals who don't care what the law says. If someone were to come into my home or business with a gun and malicious intent I would use deadly force to protect myself and my loved ones. @bloatedsensations I'm not saying that Jerome is a saint by any means, and yes he acted foolishly by putting innocent bystanders in danger by firing at someone who was running away, you never shoot someone in the back. I would call firing 5 "insurance rounds" a crime of passion, not first degree murder. The man was simply going about his daily business when he was forced to make a tough decision. People like to criticize after the fact, but when faced with these circumstances all bets are off.

@Hojulay I'd probably call it the same, had he fired the rounds all at once. He didn't. He left the injured robber (whom he clearly felt was no longer threat, as he left him there alone with his two female co-workers) came back a minute later, stepped over him, retrieved another gun (with his back to the injured robber the whole time) returned to the robber, and calmly fired 5 more shots into his back as he was laying face down on the floor. That's a calculated execution - 1st degree murder.

If you thought a dangerous robber posed a real threat to your safety, would you leave that person alone with two unarmed, female friends? Would you turn your back on them? Keep in mind that Ersland then lied to the Police about what had happened, and fabricated evidence to bolster his case. He had also been in trouble before for unlawfully threatening someone with a firearm.

Whether or not it was premeditated is not in question - Ersland ADMITS that it was. The only question was: Was it a justifiable act of self-defense? The Jury said no

One of them wasn't even present at the scene, the other one never fired a single shot. You don't think Ersland committed a murder, so seeing as he was the only person to even discharge a weapon that day, you must not think that a murder took place. If this is so, how can the two criminals be charged with murder if no murder took place?

But that is more of a sketchy issue, certainly though, if Ersland gets charged with murder, so should those motherfuckers. He said, himself, that's why he shot him five more times, because after the first shot to the head, he "kept moving." That's why he went and got another gun (He'd expended all rounds in his first gun chasing the other robber down the street and shooting at him haphazardly in a populated area) and put 5 more rounds into his back - to make sure he was actually dead.
