  • If a police officer has reasonable suspicion, he is allowed to search the drivers seat / area. However, he can't search the rest of the vehicle without permission.

    Just the other day I was doing a ride along with my local PD. We stopped a vehicle and the officer said the driver and passengers seemed very nervous. The officer searched the drivers area and found nothing. He then asked if he could search the rest of the vehicle and the driver said no. The officer said OK and the people left.

  • @NYSP22DAVID Wrong. Even if officers believe or appear to believe that there's something illegal in the car, he still must have the consent of the driver, or get a warrant first. He cannot legally search a car without either of those two. However, they can search without those two only if they see it in the plain view of the car if it's not hidden. If they see it, then they can just arrest them. But they cannot search for anything in their car after that. All they can take out is what was there.

  • @dmana3172 Your wrong as well. There are instances were an officer can search a car without consent and without a warrant. They are a search incident to arrest and an inventory check. An inventory check with out a warrant or consent only occurs however if the vehicle has to be towed, in which case the officer does inventory to protect the dept. from fraudulent charges of theft or damages

  • @dmana3172: Nope. They can search a vehicle without a warrant BUT they still need to have the same anoutn of probable cause needed for a judge to issue a warrant.

    In other words, the only real difference is that they can search, then take their probable cause info to a judge. If the judge decides that they didn't have sufficient probable cause for a warrant, then anything found in a search can be disallowed in a trial.

    Judge aren't seriously going to let people get away with possesion of weed just because they didnt consent to a search

  • @badpanda84 unless of course some lawyer or bike group threathen or bribe the judge before hand then the juge might say there was no probably cause.

    Otherwise judges dont care and will general take the side of the cops

  • would if your a minor? im 16 if a cop pulls me over when im walking or sitting on a park bench with weed in my pocket that he dosnt know about but serches me and finds it? can i say "no you may not serch me" if im under the age of 18?

  • @IrishJimmyB they would be allowed to "pat you down" meaning the outside of your clothes for their safety and your own my suggestion would be not to carry weed in your pocket keep that stuff at home dude and do what you do in the privacy of your own home you know what im sayin?? Less risk to go to jail that way believe me jail is absolutely no fun when you could be at home smokin and not go to jail.

  • Good interview on the ThePowerHour [dot] com radio today. Several cops called in to say they can search any car at any time no matter what. But in 2009 the US Supreme Court in AZ v Gant ordered that once a driver is "in custody" outside of the car, cops cannot search a car without a warrant or permission (or inventory after arrest and tow impoundment). Gant now on appeal by the State in TN v Clifford Clark, accused redlight camera sniper case dismissed after cops confessed to shooting a camera.

    IN that case the cops clearly stated that he has reason to belive you commited a crime and that he isnt just randomly searching your car.

  • If you refuse to allow them to search your vehicle, be aware they may detain you for somthing else, for any reason they can think of........ If you have nothing to hide just allow them to search the car.

  • Because there is a document called the constitution that protects us from illegal searches. I always say no because it is my right. Even though I say NO, they search anyways. They are spitting on the constitution when they do this. I love going to court to fight minor infractions when the cop has done an illegal search as they walk out red faced and embarrassed. If it is ILLEGAL, they should be fined/jailed for braking the law. COPS HATE THE CONSTITUTION BECAUSE IT PROTECTS US FROM THEM!!

    Once you refuse the search, you are then not being detained right? so theoretically you could get in the driver seat and drive away before he radio's in for a K-9?

    Another way of dealing with police is to tell them you have Hepatitis A and are in a contageous state....my friend did that and the cop literally threw his licence baxk at him and told him to get going.

  • Don't let this junk get you in trouble like Jody said. In THIS state at least, ANY violation is an arrestable offense. Yes, ANY. If they pulled you over with probable cause (failing to yield, no turn signal, etc) they CAN arrest you for it. After arrest, before towing the vehicle they HAVE to do a MANDATORY inventory of that vehicle to ensure all contents are accounted for and nobody steals your stuff. Get the picture? If they find anyhthing during the inventory you can be charged with it.

    I always refuse consent when asked. It's never been a problem.
