Both individuals were commiting the offence of resisting arrest by failing to comply with the officers orders to place there hands behind their back. According to police use of force models physical control which includes punching and kicking can be used to affect arrest on a subject. Kicking might look a bit harsh but obviosuly it is completley legal given the circumstances. The whole thing could have been avoided if the two subjects did not resist arrest. End of.

It wasn't a lawful arrest. In a free country it's your right to resist an unlawful arrest. If a cop doesn't have the legal right to arrest you he's committing an assault, and you're allowed to defend yourself.
But the cop won't be charged because the Vancouver police (who investigated) felt that although he did not have the authority to arrest, he did have reasonable grounds to believe he could arrest, and for a cop, that's enough for a defence.

It wasn't a lawful arrest. In a free country it's your right to resist an unlawful arrest. If a cop doesn't have the legal right to arrest you he's committing an assault, and you're allowed to defend yourself.
But the cop won't be charged because the Vancouver police (who investigated) felt that although he did not have the authority to arrest, he did have reasonable grounds to believe he could arrest, and for a cop, that's enough for a defence.

My relative spent 1 year in uni to become a cop, when he became probational constable after 1.5 yrs he killed this guy he swore he would kill beforehand. He got investigated and got off with a discharge with no jail time. If he killed him not being a cop he would have got 15 years in jail! Be a cop so you get a free kill with no jail time.

As of today 9 August I officially hate police- I was pulled over by a cop car and given treatment belonging to a criminal- because my plates were 'illegal', what bullshit, I had a valid permit and the plates were mine. The copper raised his voice, threatened me, followed me for some time, said I'm looking at 3 fines at least.
Very dissapointing, I no longer trust Victoria Police, ever. They should be chasing real law breakers not good citizens, I'll be taking action against them soon.
