Thanks. Edward Lawson provides a lot of facts and details. I do not hear many phrases or expressions from him that have been overused to the point of losing their intended force. He speaks well. He has a facility with words.
I think it is ironic that right after Mr. Lawson says the officers do not obey the law, a police vehicle makes a U-turn in a business district (3:58), which is illegal (CVC 22102), unless the vehicle has a lighted red lamp visible from the front (CVC 21055), which it does not.
I assume Mr. Lawson filmed where he did so as to give the police an opportunity to screw up.
police respond to calls with their lights off too. if the officer was not responding to a call then yes it may have been illegal. but we dont know that so dont call out the officer for doing something illegal when you dont know the officers reasoning
If the police vehicle does not have a lighted red lamp visible from the front, it is unconditionally illegal in California for police vehicles to disobey traffic laws, regardless of the officer's reasoning.
If the police vehicle IS displaying such a lighted red lamp, then whether they may legally disobey traffic laws depends on other factors, such as whether a siren is reasonably necessary, whether they are on an emergency call, etc..
Your Miranda analysis is flawed. First, your fifth amendment rights do not vest on arrest. Also, the best "right" to invoke is not the right to remain silent, it is the right to an attorney. If you ask to remain silent, they can resume interrogation later; not is you ask for a lawer.
Good point. Thanks. Good legal point. Have you won a civil rights case in the U.S. Supreme Court? Edward Lawson did. He's got a video about the case right hear on YouTube. His case has been sited in 100s of later cases about police stops.
I have not won a civil rights case in the U.S. supreme court, nor have I tried. I am glad that Mr. Lawson won, however. I don't think we can have too many rights. But, just because Mr. Lawson won a case in the Supreme Court, does not mean he got an A in criminal precedure in law school ;)
Flying while black? What a bunch of racist nonsense. Being frisked is not at all unique to blacks. I've certainly been frisked. And my wife (52 years old, white, and government employee), who flies much more often them I do, was frisked several times, and subjected to a chemical puffer twice, just last year alone. And, if she were as confrontational afterwards, surely the cops would have been called as well. By the way, the Supreme Court, not you, decides if the searches are constitutional.
Flying While Black - Police Arrest Black Guy - is the title of this video on YouTube. We selected it to get some hits from YouTube viewers. We think "the Blessings of Liberty" have been damaged by the George Bush administration. We'd like to see the Liberty of Americans restored somehow in the years ahead for Edward Lawson, you and white, government employees as well. Any bright ideas?
Yes, I get it. But you also don't have much respect for anyone else's rights. Attitude does play a role in how people will see you and are judged, and unfortunately lives will be inconvenienced by security. You even failed to pay a simple traffic ticket for driving without headlights after dark. Your attitude will get you plenty of attention from the law. What it won't get you is wisdom. Good luck.
The Headlights After Dark ticket has been challenged in court, and it was at the time of the airport arrest. There ought not have been a bench warrant at all based on that traffic ticket because the ticket was being properly and legally challenged in court at that time. So, no the simple ticket was not paid - it was challenged. Challenged in traffic court at the time of the Airport arrest. "Security ought to be inconvenienced by Liberty" in America.
You wouldn't have a warrant if you acknowledged your ticket in court. You didn't pay it, simple. I'm sure there's more to your story than what you say.
Not so. The Traffic Court Judge erred. The warrant he issued was unlawful. It happens. It happened this time. Courts make mistakes. Court Clerks make mistakes. This Judge erred. The Ticket was acknowledged in Court. Edward Lawson appeared at Court as required. Never missed a hearing date. Was never late. The California Supreme Court is looking into the legal proceedings related to this Headlights After Dark ticket. What you may not understand is that Lawson does this stuff for others who can't.
Edward Lawson knows the law. He took a civil rights case to the U.S. Supreme Court in 1983 and won! He seeks to safeguard the civil rights of Americans. He's very good at it.
Define,"Won". That was for being stopped and asked for his ID. Great, so now police need to actually see someone burglarize a store after they do it than have a possible suspect identified. This man has issues against police and authority. Civil rights seems just to be a means to an end for him.
Under the law today police need to have a "reasonable suspicion" or "probable cause" to stop and ask an America for his I.D. That's a good thing. Americans ought to enjoy the right of moving freely in public spaces in America. "Security ought to be inconvenienced by Liberty" in America
Reasonable articulable suspicion is required (Terry v. Ohio) to detain a suspect and conduct an investigation. Depending on the state, the officer can request identification -- this can be provided verbally and does not need to be a physical item, unless you're operating a vehicle (e.g. showing your 'papers'), even though most officers will try to make you think you need to.
Probably cause is what's required for arrest -- at this point, they may search incident to arrest and get your ID anyway.
Edward Lawson won in the U.S. Supreme Court. The decision stated that a person does not have to provide I.D. if there is no probable cause for the stop. That decision was 1981 in the 9th Circuit and 1983 in the U.S. Supreme Court
The Supreme Court? Where are you getting this? Listening to traffic ticket appeals? Come on. Sure, mistakes are made in the justice system I'm sure. If he appeard in court and lost, he'd have a fine. Don't pay the fine, you get a warrant just like he did. Warrant means jail. I just hope he doesn't plan on distracting security at an airport again, especially if I'm in it. I don't feel safe with people like this guy around.
California Supreme Court. He appeared in court. A number of times. With the same judge. His case was then moved to another judge. He never lost. No fine has been imposed.
It is clear you have different values than those of Edward Lawson. He works for liberty and civil rights for Americans. There are other values. Law & Order. Discipline. Respect for authority. To feel safe. Lots of values. Edward Lawson works to rock the boat, to kick sleeping dogs awake, to seek liberty, civil rights. His work includes legal action in court. Empowering individual citizens to fight for their civil rights. To challenge unlawful conduct by authorities.
Those are worthy efforts on his part. I see his 1983 U.S. Supreme Court victory as a good thing. He did it pretty much on his own. He tells the story in a video that is on YouTube. It's very interesting. He has more information on his website.
At 3:32 in the video: "I have no respect for the law." "What respect can law abiding people have for a law that does obey the constitution..." Does even not obey the basic practices of its own [police] department.
Wow Brotha... your very intelligent... I would only hope that you exercise constitutional rights & get a civil rights lawyer to sue the HELL out of those unritious BASTARDS that violated you !!!! God Bless you my brotha...
Instances such as these infuriate me but also compel me to further educate myself about the legal system, and how I one day CAN change it for the better. THIS is why I want to become a lawyer. To advocate and change injustices such as these witnessed by Mr. Lawson and that happen to others who are often powerless to change the course of events. I will help to change this injustice one day, not only for me, but for all others who want a fair chance to lives their lives! I want to create justice!
We are moving towards a police state. Thanks for this vid. This is one reason I (a person with no warrants or links to terrorists) hate airports; the police presence is suffocating. Also, American cops tend to be arrogant, ignorant bastards who think the law is what they say it is; these pigs have no respect for the law. And they expect us to respect them?!
As of Spring 2008 there has been no next step to this Long Beach Airport arrest. Edward Lawson did get stopped and jailed overnight by the Los Angeles Sheriff's Department in 2007. His 1983 U.S. Supreme Court victory is a story told in another video on YouTube. He has a website as well.
Now I know what this is about. You guys bore the people who work in the system so much they can't deal with it, so they do whatever it takes to make you feel like you've had the last word. Just like this youtube clip. If he ever becomes a real victim of crime, like being robbed or having his car burglarized, I hope he can swallow his pride and call police. I'm done.
A number of Americans are challenged by unlawful conduct by law enforcement officers - it is common. "Wherever there's a cop beatin' up a guy." - from the Grapes Of Wrath
