It's an IR LED that you can't see with your naked eye, but most camera equipment without an IR filter will pick it up. Siri is designed to turn that sensor on to detect if you have the phone up to your head, just like the phone does when you make a call.
This is like how nintendo said the wii couldn't play dvds, a new one would have to be realeased. so hackers made an app to play dvds (that i can confirm works). and how oems said android >1.6 wouldn't run on my g1/dream, so i now have 2.2 on it

I'm sure Siri will be available for all compatible iDevices with iOS6 because Siri is a big competitor of Google and Steve Ballmer recently says "Google is afraid of Siri".
I don't think it will come this year because iPhone 4S need to keep his new features to be successful but it will inexorably standardized on maximum iDevices. Remember actual Siri is a public beta-test.
