On what grounds is UCMJ better equipped? A UCMJ means the US accepts the prisoners as soldiers which opens calls into question the American treatment of "POW" and requires investigations into waterboarding which itself is a warcrime punishable by death, you go down that root KSM will not be punished until those who waterboarded are.
