Sasuke fails to kill Itachi, read the manga wow. He couldn't counter Susano, he had nothing left and Itachi could have ended it. Instead, he used his last bit of chakra to set up a trap is Sasuke's left eye that would trigger Amaterasu uppon Madara's eyesight so they can never meet. Also, it is said in the manga that Itachi was already injured before the fight. We don't know much about it, but it's safe to assume that Itachi was far from being 100%.

He didn't harm anyone, even back against Jiraiya, he makes sure to stay between him and Kisame.  Itachi is the good guy and never intended to kill Sasuke. Hell, even Orochimaru was afraid of him and Kisame respects him, which tells alot about his power. You are just wrong about your last line, Itachi NEVER tried to kill him.
