Three possibilities, not necessarily mutually exclusive.
1) The GOP has said if he tries to prosecute them then they'll block all his appointments.
2) The CIA is blocking the release of the OLC memos.
3) Obama is playing it tactically. Right now if he went after Bush/Cheney the wingnuts would scream and maybe convince moderate republicans that it's partisan persecution. After he releases more documents, the moderate republicans will be screaming at their congresscritters to prosecute.

As do I. He's not doing so well with his picks for financial advisors. Geithner and Sumers both need the boot as well as any other Robert Rubin associate. Hopefully, all his Justice picks are not just looking to cover Cheney's ass.
