A non-Hispanic man is driving down the street in AZ. He runs a stop sign. He gets pulled over. He's asked for a driver license. He doesn't have one. He has no distinctive accent or any other indication he may be a foreigner. He gets sited for the traffic violation and punished for driving without a license according to AZ law. End of story!

Now make that man Hispanic. Does the officer let him go on his way at the end or does he take further steps to make sure he's here legally?

If you had ever been to Arizona, you wouldn't even ask this question- A large percentage of the people who live there are of Hispanic descent, or of Native American descent. I was pulled over in Arizona 20 years ago, the Officer (Who happened to be Hispanic) Asked for my Drivers license (Which in most states is proof of citizenship) and then asked me why I was in AZ-

But I guess you think Hispanic cops asking people without drivers licenses for more info is "Profiling"...

The fear is that under two identical circumstances involving a Hispanic and non-Hispanic person, officers are more likely to question the Hispanic person. In this case, both have no DL, which is a good enough reasonable suspicion. So how can we be sure officers will not take race into account in this case? And if they did, how can we prove it?
