Fair use also refers to when a non-substantial percentage of a media is used, "The third factor assesses the quantity or percentage of the original copyrighted work that has been imported into the new work."

For example, if I make a Buffy AMV containing footage from one episode... if said AMV lasts four minutes, that's only 10% of the original episode.

And then there's the fact that none of it is for profit.
