  • When the Freestate project began, I was a member. They have become a group of activists turned extremist and I have been embarrassed by their bullish stupidity to the point of cutting ALL ties with them. This guy is another "victimless crime" douche that threatens all societies. This person paints a terrible picture of the Freestate movement. . The Freestate Movement is now full of weak, uneducated, and disrespectful sheep...many of which I can personally attest have criminal backgrounds.

  • Why are you people going to court and admitting guilt time and time again? Why don't you just say I have been driving for x amount of years and by the fact that my license have been renewed x amount of time the state has showed that they find no fault in the way I operated my car. I am a safe driver, as indicated by my record. I was driving safely on the date in question. I was involved in no accidents before or after I was impeded by the officer.

  • @mrrodneyalong I request that the court have the equipment the officer was using tested by an Independent lab in which I am allowed to witness the testing. I also request the logs records and any other papers that track the general maintenance and repairs for the equipment used on the day in question in the attempt to witness my speed. I also ask for a copy of the officers certification on the equipment in question.

  • @mrrodneyalong ask the officer directly if there has ever been a malfunction of the equipment- ask speciftly if it has ever gave a speed reading when no cars were traveling towards or away from the unit. Ask him if it is not true that the unit will sometimes show a speed when no cars are around. Ask if he knows that the equipment is not 100% accurate. Ask if it is possible that the equipment malfunctioned at anytime that day or any other day.Then ask if they ever require maintenance.

If you break the traffic law even if you harm none you should be charged. Even though you put the cop in some danger. I bet you hold to the same theory as some civil libertarian do no harm no charge.   • The reason he was found guilty was simply because he had prior citations for the same reason,ive always said fight the first ticket not the second,their is a huge conflict of interest in our corrupt system,judge couldn't explain precisely what the fee was for,no officer present,just a witness,judge is conveniently located near the precinct,not to reduce errors,think the same radar guns being used by the officers are usually donated by the insurance companies to the officers to improve safety?

I believe that every American trained in the use of firearms should have a right to both conceal and open carry in public. That's a basic right. Going 24 mph over the speed limit is not a right as it endangerers every other motorist on the road. Not standing up just makes him look arrogant. It's Live Free or Die, not act like an idiot or die.

    This is going to be a biased, but "theoretically" if I was going 120mph at 2:00am on a completely empty highway in a car designed to handle much more, how does that hurt anyone, or even threaten anyone? Inattentive, careless, or even just bad drivers are more of a risk that someone just speeding.

  • The minute the Officer opened her mouth he should have objected Foundation then waited to see what the judge said then if the judge what Foundation he could have said that question calls for facts not in Evidence. Especially the area where he was nailed is that the legal posted speed limit(Speed Survey) Must proceed It's Over before it even starts!!!!

Prosecutor is not well prepared with proper documents when the Judge inquires as to the defendants driving record, defendant shows up to court in shorts/t-shirt which while disrespectful on its face to begin with, is not quite as atrocious as his statements made regarding the rules of the court for standing to address the court. The prosecutor should get her s**t together and the defendant desperately needs a few lessons in courtroom behavior and respect.

  • Question for someone more in the know than I but why when making closing statements would the judge ask the prosecutor about his past driving record when he isn't supposed to take any new evidence into consideration?

    In fact, why would the judge ask that at all? Shouldn't it be up to the prosecutor to introduce any facts pertaining to the case free of interference or inference or questioning from the judge?

  • The Judge has found him guilty before asking about his driving record. The fine or punishment he then hands down will reflect how many similar driving offences the guy has committed. The sentencing has nothing to do with the prosecutor.

    The judge either is somewhat surprised and a bit dumbfounded that Barskey had said this and didn't know what to do or he deliberately is dragging this on or a combination of the two.

  • We don't have a debt prison in the country. If you put someone away until they pay the debt, they can't work to pay the debt off. If he refuses to pay, they can take away his "driving privileges" , and then he can be a traveler instead of a driver.   • Should traffic laws be any different from any other involving the voluntary interaction of a group of individuals? Laws in this supposed constitutional republic government are to protect property. Your person being your property. If an individual does not threaten harm or cause harm to another they should be no more fine or punishment then for anything else. This isn't about waiting till someone gets hurt. It's about waiting till someone is being aggressive or threating. Otherwise it's precrime.

  • So, if a cop sees somebody driving 80 on a residential road on a clear day with nobody around, they should leave the driver alone, but if the same thing is happening and Granny is about to hobble into the roadway, the cop should then step in? No harm, no foul?

  • If it's reckless driving then intervention would perhaps be reasonable but some arbitrary rule of X MPH is illegitimate. Speed in and of itself has no bearing on safety. It is the act in relation to others and their property. If you really want hard and fast rules for roads... advocate for private roadways. No one will have a leg to stand on WRT rules of the road. Your problem stems ultimately from government ownership of the means of transportation.

  • Setting aside a private ownership ideal, who determines what is reckless? That's why speed limits exist, to a large extent. Sure, you think you can make that hairpin curve at 50 in your lowrider...but if you can't, you'll be parking your car in somebody else's garage without their permission. Without limits, in my pessimistic view, I think people would intentionally "speed", thinking they could handle it even if they're wrong.

  • They intentionally speed now. The biggest problems on the road are detractions and false senses of security. Really there is nothing that can be done about the former but WRT the latter some studies regarding the topic have shown that *less* signage and restrictions make people *more* aware of their surroundings and more cautious while driving. Less expectation on others and their behavior.

  • Even so, somebody on the same curve might go off the road at only 15 miles per hour... but it's much less likely.

    I think I'd rather keep some limits, but weigh the existence of those speed limits against whether exceeding said speed limits would be inherently dangerous to life or property. If so, they are mandatory maximum speeds, if not, it is merely a suggestion.

    Another question for you that I think falls in the same vein: Do you think people should be allowed to drive drunk?

  • So long as they do not threaten others it is no different from any other intoxication or being tired. The danger is not inherent to the alcohol but to the reckless actions. You can try to apply positivism to this problem and forever play catchup or you can create a system based on harm which catches all cases.

  • My problem would be that it would catch them AFTER the harm has been done. I see where you are coming from, but I struggle to see the justification of trading enforced lower travel speeds for increases in injuries.

    I'm all for turning many of the freeways in my area into autobahn, but I totally see the point of speed limits in school zones.

  • I can see needing to give people a slap on the rist for some thing like not attending jury duty or speeding but at this point it's just review generation. It's doing nothing to make society work better it's just an excuse to make money. There should be a $50 cap on victimless "crimes" and some should just be dune away with.

  • Littering is not victimless. At least it shouldn't be. It is trespassing and pollution. An infringement on the owner's rights to their property. The reason littering is a problem is because of the lack of property rights as created by government monopoly on road construction/ownership. Tragedy of the commons. Speeding is entirely different. Should there exist "public" government land the only reason for punishment against an individual should be due to harm or possible harm to another.

  • Going 25 miles over the speed limit causes possible risk for at least this dumbfuck and anyone else unlucky enough to be on the road with him.

  • How could you possibly measure the risk without knowing the road and conditions? People regularly do 20+ over the speed limit on highways and police leave them alone unless they drive recklessly. Speed is not an indicator of danger in and of itself. NH roads I've found are often rated for speeds slower then similar roads in other states... by a good 10 to 15 MPH in some cases.

    The judge just wants it to escalate to Bench Warrent so he can appear as if the man did not handle his part in the matter which he clearly didn't want any part of.

  • He was screwed as soon as he voluntarily entered the court room and stated his name. As soon as you do that, you implicitly agree to a contract with the judge and are bound to the conditions that the judge imposes in that contract.

  • By Law you are bound by what the Judge decrees whether you enter the court room or not. In fact if you refuse to show up for court that's a Felony alone even if the original charge was minor in nature and a bench warrant will be issued for your arrest by the Judge.

  • There are ways to get out of it, but most people don't bother as they would just rather pay the ticket and be done with the hassle, and that is part of the grand scam.
