Gates was breaking down the door - a woman saw it and called police like she should have - he was arrested because he did not want to provide ID once he saw that the cops were white and furthermore, yelled racial slurs at the officers, which was obviously not shown on one-sided CNN. He chose not to do so, but continued to be disorderly. He was not forced to be outside his house when the officer was leaving. You do not know the facts of this case. The problem was that Gates was not arrested for being disorderly in his own home. He was arrested for his conduct once he left his home and began following Gates, AFTER Crowley determined that Gates did reside there. Gates would have been fine if he would have simply remained inside his home, and if he wouldn't have launched his tirade outside.

Even if you are outside, on your own property, you are not "disorderly" under massachusetts law, which the cop broke. If there was a suit, the cops would lose. The cops are sued for this kind of thing all the time, and they usually LOSE, because of our constitution, that the republicans love to hate!

Your residence also includes your front porch, property, etc. The newsman on MSNBC said year ago, also in Cambirdge, he was similarly arrested on "disorderly-conduct" charge. Charge was dropped, the newsguy sued, and won a substantial amount of money, including court costs. Thes cases happen all the time, and the cops always lose. If you listen to the phone report, it does not mention race, but the police-call report does, conflicting with the cop's and caller's accounts. So the cop broke laws!

No links but there are at least 2 legal precedents that support Gates. The 2004 Commonwealth v. Lopiano decision and the Commonwealth v. Mallahan 2008 decision both upheld the rights of citizens to be verbally abusive to police officers even in a public place. Look them up if you are actually interested. Also, it does not matter if Gates owns the house or not, he is the legal resident.

In Commonwealth V. Mallahan the court stated "Words alone are not sufficient to establish tumultuous conduct. " Gates would not be guilty of "disorderly conduct" even had this incident occurred off of his property since his only alleged act was to use foul or offensive language.
