Each of the Supreme Court Justices are ALL supposed to be able to judge based on everything within the laws; each Justice is NOT supposed to be judging based on their background; Justices who came from a lower class shouldn't be bias towards poor people and her being Latino shouldn't be specifically interpreting from a Latina viewpoint. They're all supposed to be NEUTRAL.

Sotomayors answer in the senate hearings have been evasive. She dodges questions with her vague answers. She couldn't answer a simple question, "does one have the right to self defense?" Sonia it's a simple question, yes or no.

For example, everyone has the right to self-defense if someone's trying to kill you, criminal or civil.
But what if someone says they're going to kill you a week from now?

To Sotomayor Roe v Wade is settled law but on gun ownership that is a fundamental right when she stated I'm not taking an opinion on that issue, because it's an open question. What open question? If Roe v Wade is settled the second amendment should be as well but not in the mind of Sotomayor. Each of the Supreme Court Justices are ALL supposed to be able to judge based on everything within the laws; each Justice is NOT supposed to be judging based on their background; Justices who came from a lower class shouldn't be bias towards poor people and her being Latino shouldn't be specifically interpreting from a Latina viewpoint. Judge Sotomayor's statement is not racist, she is just wrong. Second, I would hope that a wise white man with the richness of his experiences would more often than not reach a better conclusion than a Latina woman who hasn't lived that life.

If this woman was nominated under a republican president with a republican senate majority, the democrats would have issues with her. Simply put, democrats do not like republican policies and vice versa. If she were a conservative judge, the democrats would pounce on her. I don't think I want Sotomayor running ANYTHING political, especially the Supreme Court. From the looks of things, she doesn't even know why she's there, and I REALLY don't like the way she hides her stances on everything. She is also racist as hell, for the firefighter scandal and the "wise Latina woman" shit.

Sotomayors answer in the senate hearings have been evasive. She dodges questions with her vague answers. She couldn't answer a simple question, "does one have the right to self defense?" Sonia it's a simple question, yes or no.

That's actually a very complicated question. It really does depend on the circumstances, and it depends on whether we're talking criminal or civil defenses.
For example, everyone has the right to self-defense if someone's trying to kill you, criminal or civil.
But what if someone says they're going to kill you a week from now?
What if someone steals your car off your driveway? Can you kill them then?
What if someone kills your dog?
The possibilities (and answers) are endless.

It's not hard at all. If someone breaks into your home, he is not breaking in to have tea and cookies with you, do you have the right to defend yourself? If you are being robbed, raped or assaulted, do you have the right to defend yourself? hmm

It depends.
The crime of assault, in many jurisdictions, doesn't involve physical contact. And many times you don't have a right to use self-defense.
And "self defense" has many meanings: It could mean deadly force, or force just enough to subdue the other, etc.
As to your exact scenario, if someone breaks into your home, YES, you generally have a right to use deadly force, civil or criminal.
"Self-defense" is an extremely complex area of the law.

Let me give you an example.
Assault is extremely jurisdiction-sensitive, but a 3rd degree tort assault might be to put another in reasonable apprehension of harmful or offensive touching or contact.
If guys are playing basketball at the Y and one player threatens to pull the shorts down of another player, that's a 3rd degree assault.
You can't just pull out your gun and blast him. :)

To Sotomayor Roe v Wade is settled law but on gun ownership that is a fundamental right when she stated I'm not taking an opinion on that issue, because it's an open question. What open question? If Roe v Wade is settled the second amendment should be as well but not in the mind of Sotomayor. Sotomayor will definitely boost gun and ammo sales as in a recent article it stated "Hand guns and the tactical weapons, sales they're absolutely off the charts."
