@River1035 The reason is that Justice Roberts is a known Grammar pedant, and self corrected the split infinitive as it appears in the constitution, Obama had clearly memorized in a more rote fashion. While it was Justice Roberts that made the mistake, it should be noted that it was in fact the writer's of the constitution that were originally incorrect by putting the adverb (faithfully) between the marker (will) and the infinitive (execute).
