  • Great reporting. Man, you would never see this on any Main Stream Media in America. I never knew this about Japan.

  • firstly, the conviction rate 99% does not only say, that there is problem in courts, but that the prosecutors are very effective

    secondly, here in czech republic the laic judges in panel usually follow the vote and the opinion of the (professional) chairman. As I spoke to the lawyer-judges, most of them said, that they have NEVER been outvoted, so this "reform" may bring no change

  • Many European countries don't have jury and it does not affect the conviction rate the way it does in Japan.

  • the japanese system is medieval. holding suspects under maximum pressure in Daiyo kangoku for extended periods of time (up to 23 days without charges), with limited access to legal council, relatives or anyone - for the sole purpose of extracting a confession, witch is more than often the only actual "evidence" that the suspect actually committed a crime.

    No interrigation sessions are ever recorded.

  • Yea well.. theirs is a culture that puts huge emphasis on untarnished public image and CV. Most defence lawyers have never won a case and even a single lost case on a prosecutors record can cause a career standstill... most won't go near cases that arn't "sure things". Same thing with the police. Advancing in a career is up to your record, witch actually causes fierce COMPETITION in conviction rates, between precinct and cities... talk about a wrong place to apply capitalism...

  • The US criminal justice system isn't fair either. If you can't afford a lawyer, you get a shitty Public Defender who doesn't have the resources to mount a good defense. But if you have money (like Robert Durst, Robert Blake, or O.J. Simpson) you can get off light. Incompetent low-price lawyers are a reason for a lot of convictions.

    Teens never get fair trials, becuase teens can't serve on Juries! If there's noone your age on the Jury, how can you have a fair trial?

  • The justice system was imposed by the Americans after WW2. Now the Anglosaxon media checks in and see how's their baby. And don't make your father mad.

  • Clue...After WWII Japan's entire Constitution was rewritten byt he USA. Part of the USA built New Japan was complete disarmament. Another part of the deal was that the USA would be a

    partner in Japanese economic revival by providing a open market free of tariffs of all Japanese goods.Japan then began exporting to the USA and the USA bought and bought while guaranteeing Japans defense by US Navy. The result was things like Sony, Toyota, Toshiba, Honda, Suzuki, Nissan etc. History..get some.

  • Uh...? What I am saying is that Japan was a defeated nation, but unlike every defeat in history the victor (USA) didnt subjugate or crush Japan..but instead helped it build itself into the 2nd largest economy in the world. A miracle thats lost on USA bashers.

  • the issue will get larger when the failings in the new system are exposed. Frankly the main issues as I see it from living in Japan is finding a person who is willing to make a decision. Once that happens often the other members just follow along.

  • The flaw in this reform is that if the ordinary people are not well educated, they can be convinced by the manner in which evidence is presented into deciding in the fashion that the lawyers want. The Lawyers then become the illusion makers.

    Are you aware that even the president has very little knowledge or respect to the civil liberty? How can you be sure the rest of the population are well educated?

    Most people I have talked to, don't care, don't know, have no idea. They think ACLU is a communist group.

  • The Japanese are better educated than Americans, I bear witness to that. Look to America and see the what has happened in the legal system because of the ordinary people being bereft of the level of education of the Japanese for example. You cannot have citizen participation in Government unless and until have thorough education. Then you know you have competent people to decide.

  • Lack of education is one of the reasons why democracy does not work and there is also one major problem which is biased media.
