  • Not only is this junk advice. Anyone in New York who follows it will get a fine on top of being denied benefits. It will say "Claimant is denied benefits in the future for 18 effective days (or thereabouts). The Unemployment Division definitely checks with employers and they mainly have reps like TALX churning out objections.   • WRONG! If someone quits a job because they don't want to fulfill their job description anymore then they will NOT get unemployment benefits, it's just that simple. What this guy isn't telling you is the EDD checks with your previous employer as to the validity of your claim. You may claim you were laid off but if you employer states that you quit or, worse yet, that you were fired for refusing to do a job that you were hired to do then the state has a right to reject your unemployment claim.

  • don't quit your job! you can work part time or reduced hours AND get unemployment. the system is so illogical that you can come out ahead in various scenarios. you can also get punished for being laid off and then accepting a lower paying gig right away. if you lose that lower paying gig, you actually get really screwed if you file for ui again. i have experienced these things.

  • This is BS. I work at an unemployment office and its pretty black and white as far as the rulings go....this guy makes it sound like you can word it a certain way and get them to rule in your favor. If you quit your chances of receiving benefits are slim to none.

  • This is all junk advice. I was an unemployment adjudicator. Unemployment law isn't subjective at all. Most adjudicators are so good and they know the law so well that there isn't a whole lot the claimant can do to alter the determination. The facts will speak for themselves during the interview between the adjudicator and the employer or employee. And contrary to popular belief, adjudicators do not favor one party over the other. Adjudicators know more about unemployment laws than lawyers, too.

  • Yea man they told me they made a mistake by calling my case a fruad. 8 years latter they are garnishing my payroll for$10,000 when i only owed them $4200. Tax lawyers tell me don't handle this situation. HELP!!! How do i stop this?????

  • I went through the same thing a few years ago. If you received more money from EDD than you were supposed to get (8 years ago) then you received an what the EDD calls an "overpayment". They add 30% of the amount owed to the balance as a penalty. In your case it was $4200 + $1,260 (30%). Interest is then added daily to the balance until it is paid. That's why they now say you owe $10,000- it's all interest plus the huge 30% penalty. If you have proof that you did not receive an overpaymen
