@fog0death alcohol is legal to consume if you are 21 or over. If you want to escape charges then I don't recommend you letting any law enforcement take your blood. Marijuana is illegal in the USA and it stays in your blood for 30 days. You might be thrown in jail for something you did 25 days ago.

My point is you shouldn't hold someone down and stick a needle in them without their consent just to prove he/she was drinking a legal beverage. If you want justice then let the liquor kill him.

@bsimons100 Unfortunately, this is about drunk driving. Thousands of innocent people die from drunk driving every year, heck every month. The reason these innocent people die is because drunk people crash into them.

To prevent this from happening, cops need to find out who is drunk and who is not. If cops can't get a breathalyzer test, they have nothing else to do but draw blood to find out if they have alcohol in them.

My solution is not invalid, it is completely valid seeing that the suspect REFUSES a breathalyzer test. If he doesn't want a needle in his body, then simply take the breathalyzer test.

Either way will work, but usually sane people will go for the breathalyzer, unless they are guilty in which case they will refuse and instead get sent to a hospital for a blood sample.

You do not have 'old' blood nor do you need to stimulate your body into producing 'new' blood.
