The people who own that hospital are retarded. It's unfortunate that Alcohol is even legal, who the fuck what's to become a retard and get liver/brain damage? I don't understand it, and this hospital is apparantly a Christian hospital. Well let me ask you Christians, shouldn't we RESPECT our God-given gift, our brains which seperate us from animals?
Any one here ever hear of the fifth amendment?? Self im incrimination does that ring a bell. How about this federal law you hear of it; Title 42 chapter 21 subchapter 1 1983
1983. Civil action for deprivation of rights
Look that one up on search engine. The hospital, doc and nurses may get sued
@bsimons100 You are absolutely retarded. Drawing blood from people who refuse a breathalizer test, and people who are unable to take such a test (due to injury; unconsciousness) is legal here in Canada. Because here in Canada, we use our brains. I mean come on, what else can the cops do if the suspect refuses a breathalyzer test? Heck if you were in Russia or something I bet you would go straight to jail for refusing the test, afterall only guilty people would need to refuse it.
@fog0death You might be considered smart in Canada or Russia, but in the United States of America you have "shit for brains". That is what makes our country better then yours, we don't hold people down and stick needles in them and hope they are drunk. How fucking dumb are you?
@bsimons100 LOL THAT IS HILARIOUS. I'm sorry dude but you see, I'm something called a MAN, and I honestly don't give a shit if I had to get a needle stuck into me, ESPECIALLY WHEN I REFUSE THE BREATHALYZER TEST. Anything I would say would just be to get out of the situation and escape charges, and that's exactly why a person would support this hospital, in order to get out of charges in the future. Wouldn't it be amazing if someone could get out of being charged by refusing a breathalyzer test?
@fog0death alcohol is legal to consume if you are 21 or over. If you want to escape charges then I don't recommend you letting any law enforcement take your blood. Marijuana is illegal in the USA and it stays in your blood for 30 days. You might be thrown in jail for something you did 25 days ago.
My point is you shouldn't hold someone down and stick a needle in them without their consent just to prove he/she was drinking a legal beverage. If you want justice then let the liquor kill him.
@bsimons100 Why is marijuana illegal in the U.S.? Is it because if people could grow hemp, then the cotton industries will be out of business? Is it because if hemp was legal, then the paper industries would suffer too?
@bsimons100 Unfortunately, I'm not a criminal so I don't think that's amazing. I think that's horrible. But that's just my opinion.
Also, what you just said shows a lot about Americans. They're all drunk dumbasses that support eachother in their drunk crimes. I wish they banned that bullshit alcohol, and I wish they legalized marijuana, because smart people know the differences of the two.
@fog0death It is legal to drink in USA and if being a dumbass was illegal , our jails would be filled with Canadians. My advice to you is don't let anyone stick you with a needle.
@bsimons100 Oh and in the future if you try to argue stuff like this, you might want to give another possible solution to the problem. Because until there's a solution, then there's nothing else we can do except draw blood from people who refuse breathalyzer tests.
@fog0death My solution is let the liquor kill them. You don't live long with a serious drinking problem and sticking needles in people does nothing to help the situation.
@bsimons100 Unfortunately, this is about drunk driving. Thousands of innocent people die from drunk driving every year, heck every month. The reason these innocent people die is because drunk people crash into them.
To prevent this from happening, cops need to find out who is drunk and who is not. If cops can't get a breathalyzer test, they have nothing else to do but draw blood to find out if they have alcohol in them.
@fog0death If my solution is invalid then Why won't the hospital stick needles in people who might, or might not , have a legal substance in their blood??
It is your solution that is invalid and that is why it is not practiced. Any more questions?
@bsimons100 The hospital won't stick needles in people who might or might not have alcohol in their blood, simply because they are pussies who value human rights over HUMAN LIVES. People could DIE if those drunk bastards go back to the streets and drive their cars around, crashing into people.
My solution is not invalid, it is completely valid seeing that the suspect REFUSES a breathalyzer test. If he doesn't want a needle in his body, then simply take the breathalyzer test.
@fog0death Giving blood has nothing to do with being arrested. A Cop can arrest you just for looking drunk. Therefore if "People could DIE if those drunk bastards go back to the streets and drive their cars around, crashing into people.", then it is the cop that is acting drunk and according to you, should be held down and stuck with needles . A good cop would never give the keys back to a drunk even if he/she refused to give blood. Does that happen alot in CANADA?
@bsimons100 "A cop can arrest you just for looking drunk." That's against my basic human rights which are located in section 1, 7, 8, 9, and 12 of the Canadian Charter of Rights.
I'm sorry but your country is messed up if they can do such things to you. Maybe you should talk to the UN to fix your country up? I think your authorities are abusing you guys.
Here in Canada a cop needs proof that a person is drunk before puting him in jail, and we get that proof by either breathalyzer, or if
@bsimons100 the suspect refuses then the other option for them is to get stuck with a needle in order to see if their blood contains alcohol. Either way will work, but usually sane people will go for the breathalyzer, unless they are guilty in which case they will refuse and instead get sent to a hospital for a blood sample.
@bsimons100 By the way, did you know that it's good for the human body for some blood to be removed once in a while? Maybe I'll go donate some of my blood later, I've been stuck with the same old blood for too long I think, I need to simulate my body to renew it's blood supply.
@fog0death You do realize that your blood is replenished over time. Our erythrocytes only live three to four months... You do not have 'old' blood nor do you need to stimulate your body into producing 'new' blood. It takes a healthy adult male twenty to sixty days to reproduce the lost RBC taken during a normal 'donation'. It's ridiculous that they want to draw blood for an DWI without consent.... It also causes scar tissue where the needle tears a hole in the skin and the vessel. Enjoy..
@joeschmeaux Actually no, that isn't correct. The law of 'Implied Consent' waives malpractice. IF you are unconscious how do you plan on consenting to treatment??? However, an EtOH test NOT for medical treatment requires a court order (or warrant depending on jurisdiction.) BTW I was an Army medic and EMT for many years an most nations have Implied Consent laws. ***WATCH AND READ THE OBAMA CARE LAWS - THERE IS A CHANGE IN THIS LAW AND THE 'CHANGE' IS WRONG***
Sorry, but you come in and I have a order, You will have your blood, urine or what ever is on the order done to you. The law has correct paperwork so be it. Your body, you know and there you go
Your line of thinking is exactly the same as the Nazi Concentration camp workers just so you know. Ze rules must be obeyed like ze word of God/Fuhrer.
first of all the 4 th ammendment is giving them the right to search . if they have probably cause and a search warrant . know taking sombodys blood is a whole entire different issue ..... thats not searching if anything thats violating sombodys body .
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
For those of you that did not understand that, it is the fourth amendment to the US Constitution (#4 Bill of Rights). If a police officer obtains a warrant upon oath of probable cause, they can draw your blood in cases of DWI. The hospital is violating court orders by not drawing blood. Anyone that disobeys a legal order of a criminal court should be arrested and charged.
By following the law that was instituted and backed by the constitution? That does not make us a police state. Police authority has limits in this country. Please observe actual police states such as Sudan, Zimbabwe, Chad, China and Burma. Don't drive while intoxicated and you and other citizens will be fine. Police must have probable cause and if they do not, the warrants shall not be granted. I am sorry, but I have friends that have immigrated from actual police states....
Believe me, this is NOT a police state and for those of you who actually believe it is, please travel the world and then you see what a police state actually is!
Just because American slaves a little more freedom of movement doesn't make it any less a police state, did you miss Ruby Ridge, Waco, the fancy tank work in Michigan or so many other instances of para military police violence rained down upon American citizens for what are essentially victim-less crimes
Being a little better than the worst doesn't make it a great place to live. No law for the rich but nothing but laws for the working slaves. Fines for everything from smoking to parking "wrong"
IamGreed, I just made a comment based on my views. This is America, isn't it? Just like you are making your filthy comment. Why don't you get a job (and get a life while you are at it).
I have a solution... go fuck yourself you Fascist cunt. Just because stupid and fearful drones are willing to give up their rights and liberties does not mean the rest of Americans are willing to follow suit.
Get out of Texas. Get out of America. Real Texans and real Americans don't want cowards like you around.
Give me liberty or give me death.
Those who would sacrifice liberty for temporary safety deserve neither liberty nor safety.
takikng sombodys blood is completely different than doing a search . .... your violating sombody's body if he/she does not want it done . and any ways his shouldnt be an issure that why we have breatch alizere test . if u dont ageee to take it your license can be suspended . because on your license it says "operations of a motor vehicle constitutes consent to any sobriety test required by law".
