Salvie is still legal because;
1) the effects only last about 5 min
2) there is no known amount you can consume that is lethal
3) it is not addictive
4) it has no known ill side effects (other than acting like a foll for a few min)

The guy that killed himself wasnt on salvia when he comitted suicide. He just happened to have smoked it a few months before. Saying that he killed himself because of salvia is like saying that someone who smoked a ciggarette the day they died killed themself because of nicotine. Correlation doesnt imply causation.
