  • They are not homeowners. They are lessees. They are tenants of property owned by somebody else. If I own my own property, I can keep pets, I can have kids, I can have as many other people live in my own property as I want (barring health code violations) as I want.

    But if I rent from somebody else, the "property owner" gets to decide the terms of my residency. Kids? Pets? Guns? My property -- up to me. His property -- up to him.

    I don't like the terms -- I get to go somewhere else.

No, public housing authorities are not like public parks, they are nothing more than entitlements that the government administrates. Congress represents the public; but the very purpose of the Constitution is to limit the power of Congress. Unlike privately owned businesses, Federally owned entities must abide by the Constitution; the 2nd Amendment is an inalienable right.

  • It's not about whether they got their guns legally or illegally. The point is that the government, who owns the public housing, reserves the right to evict individuals discovered with firearms - which would act as a deterrent for those who care about continuing to live in their homes. Whether they get the guns legally or illegally is irrelevant, the point is do discourage them from possessing guns no matter how they come about.

The problem is that Bachman is taking a principled approach to the issue as opposed to a pragmatic approach - it's sort of like biblical literalists who only stick to what was written but don't assess the writing for its effects. I wonder, had the founding fathers known the problems that would arise from the 2nd ammendment in the face of urbanization, if they would have supported the ammendment in the first place.

  • @HappyColouredMarbles The right to self defense is an inalienable natural right; it is a preexisting right that the Constitution protects, it is not a right which originates from government. If the government takes away the means to self defense, by proxy it removes the right alltogether. Natural rights are never a matter of pragmatism. Surely it would be more utilitarian to scrap the 4th Amendment; but then you have sacrificed freedom, for the promise of safety.

Not to mention that many contemporary societies that ban guns used for the sole purpose of defending oneself (or in otherwords, to kill others) have far less gun violence than the USA. You don't hear major protests in Canada about natural rights being violated because people can't legally own handguns, but you do see a much safer society.

The premise is important in the arguments they make - Locke draws natural law from the state of nature that he sets out at the beginning of his treatise. I stand by my opinion to reject the Hobbesian thought experiment as the state of nature. Now you do have a good point that other factors impact violence than just weapons themselves, but I still disagree that owning guns is a natural right.

I would define 'natural rights' in the Lockean sense; life, liberty, and property. The application of this in society is a balance b/w natural rights and societal obligation; wherein the exercise of one's freedom stops at the point where another's natural rights are violated. The defense of one's life, liberty, and property is a natural right.

Most likely, someone buys the guns from someone who DID attain them legally. Or they could have just gotten a license themselves considering you just have to sit in a class for a few days and you can buy one legally.

  • I hate Michele Bachmann, but she has a point here, and makes it with some competence. Now, I've seen a lot of Section 8 housing, and I think it would be best if there were no firearms in these places (thinking condo/apartment style housing here), but these people are citizens and are entitled to their rights. The Government is engaged in all sorts of nonsense limiting or restricting people's rights. You either have to resist it all, or not at all. It is a constitutional right.

I think the government SHOULD be in the business of providing this housing (although much section 8 is not 'owned' by the government), and providing other forms of welfare, but the government should not be making this money conditional on the recipient giving up their rights. I am uncomfortable, even, with conditions beyond rights.

  • Actually Bachmann hits it on the head: the Second Amendment was intended for frontiersmen and the like, who were in constant danger from animals and humans, and who relied on "arms" perhaps for hunting, etc. This is no longer a valid concern, the Second Amendment is now basically null and void. I'm all for basing your politics on the Constitution, but like any other document it should not be interpreted dogmatically, but with a healthy portion of common sense, which is so lacking nowadays.

  • I think Waters is forgetting that people will still have things even if it is outlawed. Banning guns will not eliminate guns. It will just make self-defense illegal.

    Also, public housing should abide by the constitution BECAUSE it is government-owned. The only way that a restriction contrary to the Bill of Rights should be legal is if it is private housing, in which the resident signs a contract surrendering that right.

  • Holy shit, the constitution was barely ratified. Actually, the Bill of Rights wasn't introduced until Virginia's ratification, so all but four of the original states ratified the constitution without such an amendment or bill or rights. That argument sucks. Also there was no Bill of Rights in 1787 as she is quoting, it wasn't introduced until 1789 and not ratified until 1791. So to say that the Bill of Rights was a major factor in the ratification of the constitution is impossible.

  • Ownership of property does not preclude the application of the US Constitution if that property lies within the boundaries of the US. Compliance would seem to be a given especially where the property in question is federally managed.

    The easiest solution is to defund PHA. People will appreciate their houses & neighborhoods if they have to work for them. That and they'll be at work instead of shooting at each other.

  • As much and as often as I disagree with Michelle Bachmann, I have to agree with her on this issue. I am for somewhat stricter gun controls, but not based on where one lives. I think that's not a path we want to take. We should make it more difficult for the "gang bangers" to obtain guns, thus "stricter gun controls" that make sense.

  • @guyNbluejeans - I think Michele Bachmann should have to live in public housing perhaps in Compton, California for 6 months before deciding any gun laws. She is so far out of touch with reality it is laughable. I am all for the 2nd amendment, but MY tax dollars pays for public housing, so this issue needs further study. It is easy to make rules about another community when you have no idea what that community is like.

    You sound crazy when you say in one sentence that Bachmann is out of touch with reality due to her supporting the gun rights of those law-abiding people in the projects but then say that you're all for the Second Amendment. And you then top it off with saying more studies are needed.

    Here's what's needed: Tell welfare moms to not have kids if they can't afford them. Tell them to get educated and improve their lot.
