  • The US Supreme Court has already ruled countless times that you can film anyone in public anytime. As long as your not interfearing with law enforcement or emergenices in anyway.

    Aside from that, the security guards here were telling the videographer to get off private property. THAT is certainly legal. You do not have the right to film on private property when the property owner says you cannot.

  • There is always a easement to stand on. Transit cops forced me to move off their "private property" since I was smoking. Which in turn lead to me going to the easement to smoke, which was closer to the other people, and the non smoking signs. I was pretty far away to begin with, I am respectful of others when I am smoking.

    Stupidity at its best on their part. The city cops could not force me to move from where I was standing.

On private property you can be prevented from filming, you can film on to private property if on public property. Ever go to a concert and start filming? The same thing.

  • She's correct. You cannot film on private property and you were clearly on. In some cities, buildings own a walking area or mall which they open to the public. Owners and their representitives can grant or deny access. However, you can film from public property which is the public sidewalk.

When was the last time you saw a government contractor making mall repairs. Just because people gather there doesnt mean that it is a public place. Just do a little research into private property law.

As a professional photographer in Australia, I know my rights here and it is very similar to the US. But if your just filming or taking a few shots in this kind of area, you should be aloud. In that particular area there is a grey area. Being more co-operative can help and still allow you to get your shots. But if your just trying to provoke them then your lost.

Notice the sign is in the middle of the sidewalk. The property managment there walks a very thin line with this sort of nonsense. The security guard was just being stupid. ITS HOLLYWOOD BLVD. You cant throw a rock without hitting a professional film crew or a tourist with a camera.

  • @twiggy504 The law states that you can film whatever, whoever, and whenever, as long as you are on public property.

    Of course, you cannot legally film in a public restroom (even though it is private property) because then you could be charged with something like peeping or sexual assault. Filming children is perfectly legal provided you are filming from public property.

    I don't necessarily agree with the filming the children part, either, but that's the law.

  • @themafia306 I did not say that filming was against the law in the USA as I have no idea of the laws over there BUT I am surprised that the people of the USA value their right to film more than their right to privacey and security. I would much prefer restrictions on what I was allowed to film knowing that people could not for no lawful purpose film my children, family or even myself. In Queensland Australia there are laws which restrict filming in many places.

  • @themafia306 To be able to tell you the laws in about 480 charaters can't be done but all of Australian laws are available to the public via the internet and in print from Go Print which is our goverment print shop. But for an exsample we can not film in such place as our south bank park lands on the beach area as it is used by kids, we can not film naked or semi naked kids under the age of 18 and we can not film some locations such as our ports, air ports and army bases etc for security reasons

If they don't wish to be filmed, the legal onus is on them to move to a place outside of public view - where they would have a reasonable expectation of privacy. They may wish not to be filmed. And, you may abide by their wishes if you choose. But, they have no "right" to not be filmed.

  • The legal justification of "Expectation of Privacy" is not applicable to any public lands, or any location where unfamiliar persons gather.

    Even private property is not an excuse, except where the Property Owner has expressly forbidden (In writing in clear view in all entrances) that filming is not allowed. Or in such an instance as the property owner informs you of such restriction.

    Know your rights.

    You CAN however stand on public property, and film INTO private property.

    You were on private property though, and she was asking you politely many times to leave, you should have been more co-operative, she only had to ask you once before you could have been charged.
