  • I was given a ticket for going 60 in a 40...here's the thing...it didn't happen!! I was going 25 behind someone! I immediately asked the officer if he had it on video which he said yes.  I sent a Request of Discovery asking for the video which they responded with it's "malfunctioning" and there is no video. Next I asked for audio, which they responded with "the officer chose not to turn his audio on". Of course. I already went and plead not guilty and have a trial coming up. Any suggestions?

  • I got a ticket for crossing zebra lines as it says on the ticket which is a moving violation. There are cones where the zebra lines are but I cut in right before it, which is a double line. How do you suggest I fight this ticket? If I use a picture to show the cones and say I crossed the double and not the zebra, making the ticket technically wrong, is that valid for dismissal?

  • @fsnyder350 Well...if you have a CONTRACT with your State, then what is wrong with agreeing to the terms and conditions of your contract (DL)? Just pay the Ticket. Or take your tag off your car and give them back the drivers license. It is that simple! If you submit to "Voluntary Servitude" then why would you fight the system that you protect? Either you are a slave or you are a free being. You can't be both. I don't have a DL, so they can charge me with whatever traffic violation they want.

  • I am currently fighting to Criminal traffic tickets in South Carolina today my motion to strike and dismiss those tickets were denied, i stated and filed for the record over 100 pages of case law and supreme court ruling in my favor, see TRAVELING VS.   • @fullmetaljason Well, it was quite a trip. I later found out that the DA had his head in his hands when he heard my first response to the Judge. People that make a living through lies and deception find it difficult to deal with the truth. If America knew the remedy to their "Judicial Problems", then politicans would have a hard time doing their job.

  • I just got a ticket for going 56 in a 40. Today was my arraignment and today 1-17-11 and it's Martin Luther King day so the court was closed. What would you do in this situation? Would you inform the court that they got the day wrong or would you just ignore the ticket until they contacted you?

  • @sheseekstruth777 Hmm...I would send them their Ticket back with a letter stating that I went to court on time but their doors were closed...I request that they dismiss the Charges or issue me a citation with the correct arraignment day. And in that letter I would inform them that if they decide to issue a new ticket, that I would be appearing specially and not generally. If they make a mistake, then they just might dismiss it if you hint them before hand where this will be going.

  • ALSO, cops operate under Constitutional Law by verbal contract as stated in their oath. ANY violation of your common law and Constitutional rights are prohibited BY CONTRACT. YOU have more rights and freedoms than THEY do. EXERCISE THEM. Period! DO NOT submit or even recognize them as an authority as YOU HAVE AUTHORITY OVER THEM. When a cop pulls me over I say "Are you willing to claim under full commercial liability as stated in Title 42 USC 21 subch. 1 section 1983 that I need such a thing to exercise my common law and Constitutional Right to deny Illegal search and Seizure?   • @crackerwv "Need such a thing" means license, registration and insurance. Driving is defined as "commercial use of a vehicle." TRAFFIC is defined as "the trade of goods." Neither of these apply when you are TRAVELING making it impossible for a cop to give you a ticket IF you stand up and assert YOUR rights. They have no right to even ask you for your license. That is a violation of the 4th amendment right off the bat which would subject them to the other terms and laws I described above.

  • I have 3 tickets 1 speeding and 2 seatbelts that I have been trying to deal with. I wrote ucc 1-308 next to my signature. I tried sending my ticket in for Accepted for Value returned for value and they did not accept it. Now i am in default and my license is being requested for suspension. I want to motion to go to court but a lawyer explained to me that a speeding ticket is not a contract and it is non negotiable and the ucc doesnt apply. Please provide some guidance before i go to court. thx!

  • @stinamorelli Laws are a "corporate fiction." They do not exist outside the corporation. Claiming your rights under common law prevents this. You NEVER answer questions. Answering them means you "understand" or stand under, the charges meaning you have entered a CONTRACT. Contracts are the only thing that can precede Constitutional Law or common law. AVOID CONTRACTS AT ALL COSTS. Do not EVER answer a question with an answer. This keeps you from being tagged with "obstruction of justice," also.

  • Do you put reject on ticket when officer hands it out. Some put under protest and duress. With name in cursive no signature.? You can also question official. If this a security transaction if so u its up to you to consent my opinion. Never herd about reject though

  • contracts signed "under duress" are invalid. I got a ticket in corrupt Mecklinburg VA and signed the ticket with remarque "Under duress." The cop extortionist told me he would take me to jail right there if I didn't sign. I was on my way to the beach vacation with my 6 year old son, wife and 2 dogs. Cops are dicks. Governments lie, steal and kill. Beyond that they are not good for much.

  • @provc If I were you, I would sign it and look into the A4V-method. Cops are ignorant of the Law...they only know codes and statutes...not law. So don't argue with them. If you have the balls, going to court would be an option. The worst thing that could happen would be to pay the ticket and see if i could find the early legislative documents that created the DMV in the State and look for the definition of a Motor vehicle.

  • @younitehumanity Long time, friend. Thought I would point out the definition of Motor Vehicle under TITLE 18, PART I, CHAPTER 2, § 31(6)

    Most state legislature includes "motor vehicle" as a primary term attached to driver's license requirements. Do you think this holds any validity in court?

  • @provc One has a right to sign anyway they desire. Sign in cursive, "Under Duress" or "Without Prejudice" so as not to attract unwanted attention. If they still make threats, have them call their supervisor out. If still coerced one may return the ticket to the issuing agency and a copy to the court with an additional letter pertaining to duress, all rights reserved, etc.

  • Dear Max, This seems like something that could work against a fix it ticket, while parked outside San Bernardino, Ca courts filing papers. Upon return to my vehicle, I noticed a parking ticket placed on my windshield. Reading over it, I was cited for not having a front license plate. Let's stop there! As people are conducting their legal business, why are they assigning such tickets? Simple... they are pushing for business! $ Any who, I was unaware and this is a crime against our wallets!

  • @hpmracer Money makes the world go round. You having no Tag in the front did not put anyone in danger, nor did it cause any loss. Here in NC we don't have tags in the front...simply because it is not needed...one is enough. Not really a Crime against our wallets but in fact a contractual agreement withe the State (Corporation). Sugested Remedy: A4V or Conditionally pay upon presentment of a bonefide claim

    Maybe this is your chance to fight it in Court to learn how to win. Good Luck.

  • @hpmracer If you are not aware of the accepted for value-method, then it is best that you research it first. Google is your friend. What I would do is to accept responsibility upon presentment of a bonefide claim. give them 14 days.

  • All road signs are for "MOTOR VEHICLES" only. Not for Automobiles. You decide for your self if you were in a motor vehicle. Look...if you refuse to sign a citation, then you are clearly seeking confrontation. Depending on the officer, he/she can arrest you, which really doesn't help the situation (eventhough you may be right). I would sign it...and then deal with the matter later in Court. I love going to court...It is FUN!

  • in texas all you have to do if you get a ticket for license, registration, tags, etc., all you have to do is get it renewed and your ticket gets waved.

  • @Macedon51 Make sure that your State doesn't require written notice before appearing specially. Some very well do.

    Most importantly, if you feel the judge is getting irritated, be careful not to push points to hard, revert to asking questions. Also look into "in personam" vs. "in propria persona" as generally it is important when representing yourself in court. Ultimately, courts have to establish jurisdiction, however its not a strong argument and only helps when appealing. Educate yourself

  • Good point, legal person (name on a birth certificate) is not the same as you (flesh and blood).

    BTW, the judge calling you to his chambers is offer of contract which you accepted. Be careful.

  • Judge pleas on your behalf. I accept your offer to become surety for the defendant and defend the defendant in this matter. Judge ignores you, sets trial. I object. Judge make continuous 'offers' until you accept one, keep objecting, I don't understand, I don't consent. Failure to deny is to admit- Maxim of Law. sign 'Without prejudice' (reserves all rights under UCC-1-308) and undersign as 'authorized representative' (negates any liability for whats presented on the paper above.   • @999111999111123 The Tickets (Contracts) I got were issued to me...the Officer didn't require me to sign them, therefore i returned the tickets to them unsigned. What I signed was the letter I wrote...not the tickets (Contracts).

  • It all makes sense to me, but the reference to the FDCPA Section Z is confusing me, I have downloaded the copy from the FTC website and it doesn't have a Regulation Z. Could you please elaborate? I have 15 U.S.C. §§ 1692-1692p §§ 801-819 within which I have yet to find anything related to a Regulation Z. I suspect it may have been removed or relocated to another place in the U.S.C. Keep up the Good Fight, very inspiring and educational.

  • @JEHERETIC Actually...I just happen to have a foreign DL....not that I need it, but if a cop asks for a DL and does not specify exactly what kind of DL he wants, then I'll just give him my foreign DL. I have also learned that some people create their own Travel Permit and have it recorded with the Court.
