"Congress shall make no law...abridging the freedom of speech" -The First Amendment to the United States Constitution. The Supreme Court of the United States ruled in Texas vs. Johnson that flag burning and other forms of desecration of the flag are protected forms of symbolic speech under the first amendment. There's nothing you, or anyone else can do. He's going to fly this flag upside-down and you can't stop him.
