Sotomayor was only following established state law. She had no other choice. Fact is the city rejected the firefighter exam because the test violated Title VII, the federal civil rights law that prevents discrimination in employment. Title VII requires employers to consider the racial impact of their hiring and promotion procedures in order to prevent discrimination that's inadvertent as well as intentional.
"Fact is?" because the people who took the test and happened to be minorities happened to do worse than the non minorities? What if the individuals who happened to be minorities also happened to not be as smart as the other guys?

Sotomayor was only following established state law. She had no other choice. Fact is the city rejected the firefighter exam because the test violated Title VII, the federal civil rights law that prevents discrimination in employment. Title VII requires employers to consider the racial impact of their hiring and promotion procedures in order to prevent discrimination that's inadvertent as well as intentional.

if a test is determined to be biased towards one race over another race after the results are in, then why don't we first run the test past a Judging Panel made up of a mixing pot of judges to get their approval before giving the test. whoever passes the test at that point did so on their own merit & it's not a racial Issue.

I think Judge Sotomayer will be a good judge, but until I read the whole thing, i would have to say it isn't discrimination, it's stupid policies. Me being of part hispanic heritage, i was taught by my father that you have to work hard for what you want, and earn it. I think that nowadays that we do base that on the policies of who you are and not what you have done, which I believe are wrong. You should be rewarded for doing your job and not on your nationality or race.

Actually, when I judge does it, it is called legislating from the bench. More and more, Judges are using precidents as law. It is a scary trend that needs to stop. The constitution only gives the judicial branch the power to interpret the law. The problem is that some judges view past decisions just like a law.
