    Read " Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflict". This UN document says nothing about not detaining unlawful combatants or where they can't be detained.

    He is a POW and was a child-soldier. The US is bound by two things regarding his detention: 1)Geneva POW Conventions and 2)Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflict(UN). The US can hold him until the conflict ends.

    To summarize, the Geneva Conventions provide rules for his detention. The UN protocol is easily obtainable on-line and a short read.

  • It was illegal that he was on the battlefield. It wasn't the Americans who put him there. That's why they judged his status as 'unlawful combatant' and have held him at Gitmo. There's no question that killing him on the battlefield is legal - next time they won't make the same mistake.

Under the child-soldiers protocols, the United States obligation was to try to rehabilitate him. Prove that they weren't. To rehabilitate him the US had to detain him- what else could they do?

  • Rehabilitation takes time. Rehabilitation isn't always successful. Most people in jail are repeat offenders. Khadr was thoroughly indoctrinated by Al Qaeda and was a willing participant. No doubt he would be resistant - he did betray his own country.

He is a child soldier if anything, and all child soldiers have rights and protections signed by the US, so what makes Omar different than a child soldier from Sudan or any other recent conflict area?   • He was a child under international law, and all people have a right to defend themselves against a forign invader, but in this case he was forign too as he is a Canadian...none the less it is the country his parents were born in and he has family that live there too.
