If I was you guys I would totally use that, I'd make merchandise promoting the hell out of the fact that you've been sued for useing their name. Like, "We've been sued by a paticular party so we're not allower to criticize them, but, no more Not the Democrats." Or something.
I don't think it's so frivolous. Sure there is such a thing as free speech. But no one can use a registered trademark without expecting to get into trouble. You can't go and make products at Cafe Press criticizing one of the fast food companies and copying their logo and slogans and not expect to be in trouble. Why would anyone think it was different with a political party?
Do you have the same opinion about the use of the acronym "GOP?" The thing about the elephant logo is that the RNC is also attacking other variations of the elephant, which has been a symbol of the Republican party since the 1800's.
I've heard of lawsuits that companies have started because someone used their tradmarked name or logo, whether used for good or bad. They don't want you making money from their trademarks and logos and you have to understand that if you're a business person. It should be the same with any non-profit. You can make criticisms without using specifically tradmarked names. People who design the trademarks make a bit of money for that, and they, too, don't want you using their creative talents.
The GOP is already skating on thin ice and I think the Iceberg is crumbling when they have to reach to such lows as banning the use of Freedom of Speech in T-shirts- How lame!
