well, in funk music it's like in blues. they don't care much about the modes. if I had to choose, I said it was E minor; but in fact it's a Riff in E with improvisations of the blues scale (which contains minor and major and a lot bendings, the flat 5 and so on...)

so technically it would be in both E min and G major then right? but using the pentatonic version of the g major scale and the blues transition of E min to pull away from the definition in phrasing

hm.... ok technically g major is in fact e minor, that's right. but in this case, we're not talking about a chord progression in which the key matters. this is a bass riff (which makes the whole song).

he uses the e note as a "drowning" note; he always comes back to it. that's why I'd insist in calling it more E-minor than G-major.

ok and another thing is important: Larry grahm, writing this song, didn't (i am pretty sure he didn't) think of the theory; so not all the notes are exactly...

from the e-minor scale. as in funk or other black-music genres they used most often the blues scale. the blues scale technically is a dorian scale, with an added major third (and others if you like ;-) ). so if you want improvise over it wich a guitar or a piano, i reccomend you playing e-blues or e-dorian. E-minor or G-major will sound ( in my opinion) too "clean" or tot classical for me. still you coul'd do it ;-)
