Senator DeMint is, as usual, right on the money. I'm gay myself and I know that I deserve no extra protection from the law just because of that. We are all equal under the law, someone killed for no reason and someone killed for being gay/black/muslim is no different, both are murder. To give extra rights to the latter victim is to say that the other victim has less right to justice. Unfortunately due to the political correctness brigade this law passed, flying in the face of equal justice.
it takes a special kind of idiot to look at violent crimes being committed against members of a particular social group and to then conclude that these crimes deserve 'special-extra-punishment'.
Be logical, if there's excessive violent crime then the punishment for violent crime as a whole needs to be increased not members of one group afforded special treatment.
"Thought crime"!! What bullshit! The law ALREADY has the concept of a criminal mindset, its called "mens rea" (literally, "guilty mind"), and is considered a necessary element of the crime; and when adjudicating murder, the courts consider whether it was commited with "malice aforethought." Orwellian, indeed! A man this ignorant should not be charged with the high responsibility of a U.S. Senator. I fear for our country, if people like this gain the majority.
This idiot doesn't even understand the basic purpose of hate-crime legislation (or, more likely, he knows, he's just pretending): He disingenuously states that hate crimes are committed against individuals, when the truth is, hate crimes are committed against a group, and hate-crimes are usually more vicious than other similar crimes. This is basic information that he is glossing over. He's a bigot and a disgrace to the Senate and to the American people.
"He disingenuously states that hate crimes are committed against individuals, when the truth is, hate crimes are committed..."
- this notion is utterly ridiculous, a crime does not extend beyond those directly involved in it.
If a crime committed against a gay person is an attack on everyone who is gay then so too is a crime commited against rich people an attack on everyone who is rich.
it doesnt make logical sense and there's no cut-off point to how far you can take it
@types10000 Before you make public comments it would be a good idea to actually do some research on the issue, OK? Hate crimes--by DEFINITION--are specifically BIAS-MOTIVATED violence. They are committed against groups: the victims are not chosen at random, but because they belong--or are suspected of belonging--to a particular group. However, just because a person happens to be a member of such a group doesn't mean every crime against him is a hate crime--it depends on the circumstances.
"Before you make public comments it would be a good idea to actually do some research on the issue, OK?"
- i have done the research and that is why you are forced to make assertions like that instead of addressing my actual arguments
"Hate crimes--by DEFINITION--are specifically BIAS-MOTIVATED violence" - you have failed to identify any objective for determining bias. ie. why is crime against a rich person (because they are rich) not a hate crime whilst a crime against gays is?
I sincerely doubt this; if you had, you would not consistently fail to correctly define what a hate crime is. If you have, then that means you are intentionally and purposefully misrepresenting the matter--a typical ploy of the anti-gay agenda.
"that is why you are forced to make assertions like that instead of addressing my actual arguments"
I suggest you read my posts agan. I have addressed your arguments. See my comment on computer programmers.
"I sincerely doubt this; if you had, you would not consistently fail to correctly define what a hate crime is"
again, if that is the case then please define it for me, i'd be very interested to see a definition that doesnt commit the slippery slope fallacy by being so vague that virtually any group could come under it eg. the rich, computer programmers .etc
@types10000 "i'd be very interested to see a definition that doesnt commit the slippery slope fallacy by being so vague that virtually any group could come under it "
Well, yes. ANY group which becomes victimized by hate crimes--i.e., crimes committed against them BECAUSE they belong, or are peceived to belong, to a particular group--should be eligible for protection by hate-crime legislation. This isn't a "slippery slope;" it's the law adapting itself to evolutions in criminal behavior.
"I suggest you read my posts agan. I have addressed your arguments. See my comment on computer programmers."
- incorrect, all you did was point out that there is 'There is no history of societal bigotry and violence against computer programmers' which is completely irrelevant:
ie. your basically saying that all that defines a hate crime is the amount people who do it, and if this is the case then you need to provide specific numbers.
@types10000 " all you did was point out that there is 'There is no history of societal bigotry and violence against computer programmers' which is completely irrelevant:"
no my dim-witted friend because as has explained to you several times now:
- the fact the crimes are not being pursued by law enforcement agencies due to bigotry does not have provide a justification for beefing up the penalties of those crimes
ie.
if the crimes arnt being perused then beefing-up the penalty via hate crime legislation DOESNT MAKE ANY SENSE
@types10000 I really don't know why you insist on going off on this rabbit trail about law enforcement agencies. It has nothing to do with what I was responding to. When I said, "No it is PRECISELY the point," I was responding to your assertion that no history of societal bigotry and violence against computer programmers--as opposed to overwhelming evidence of bigtry and violence against racial and sexual minorities--was irrelevant. I never said ANYTHING about law enforcement agencies.
"as opposed to overwhelming evidence of bigtry and violence against racial and sexual minorities"
i already addressed this as well:
- It is essentially saying that what determines it to be a hate crime is the fact lots of people are doing it
- For this line of reasoning to hold up you need to be able to objectively specify HOW BIGOTRY towards computer programmers .etc would be required for it to constitute a hate crime. eg. 100 murders
@types10000 Hate crimes are defined in federal law as: "crimes that manifest evidence of prejudice based on race, gender and gender identity, religion, disability, sexual orientation, or ethnicity, including where appropriate the crimes of murder, non-negligent manslaughter; forcible rape; aggravated assault, simple assault, intimidation; arson; and destruction, damage or vandalism of property. " (28 USC 534, Notes: Hate Crime Statistics).
- we've been down this road before, i asked to present these alleged facts and you couldnt, all you did was point a case and say 'the facts are in there'. you have an appeal to authority but no facts to speak of.
@types10000 The facts of the CASE. OK? It is determined on a case-by-case basis. That's how the law works. The law prescribes specific penalties for specific acts. When someone is accused of violating the law, the prosecution and the defense present evidence; then the jury (or judge, if the defendant waived his right to trial by jury) is the TRIER OF FACTS. If they decide that the evidence shows that the accused commited the acts, he or she is found guilty. The facts differ from case to case.
"The facts of the CASE. OK? It is determined on a case-by-case basis"
- whether each case is a hate crime is determined by what constitutes a hate crime and it is that which you need provide.
or would you have me believe that whether something constitutes a hate crime is entirely based on the subjective opinion of the judge? No, there is a basis for determining whether it is.
since you seem to have trouble getting your head around my first hypothetical, i will change it:
If a crime committed against a gay person (Motivated by the fact they are gay) is an attack on everyone who is gay then so too is a crime commited against a computer programmer (motivated by the fact they are a computer programmer) an attack on everyone who is a computer programmer.
what is your objective justification for one being a hate crime and not the other?
@types10000 You seem to have trouble getting your head around the idea of a hate crime. There is no history of societal bigotry and violence against computer programmers. You're just making up stupid examples to be cute. Gay bashing is a serious epidemic in this country. Hundreds of American citizens are attacked every year for no other reason than because they are--or are percieved to be--LGBT. And a number are murdered in the most horrific manner. The purpose is to terrorize the entire group.
"You seem to have trouble getting your head around the idea of a hate crime"
- then please define it for me, i'd be very interested to see a definition that doesnt commit the slippery slope fallacy by being so vague that virtually any group could come under it eg. the rich, computer programmers .etc
"There is no history of societal bigotry and violence against computer programmers" - which is completely irrelevant to changing the nature of the crime.
"You're just making up stupid examples to be cute"
- if they were 'stupid' then you'd be able to address them. tell me if a 'history of of bigotry' is required to constitute a hate crime then how much and to what extent, please be specific.
it sounds to me like your simply trying to say: 'well lots of people have to do it for it to be a hatecrime' which is both childish and illogical.
@types10000 " tell me if a 'history of of bigotry' is required to constitute a hate crime then how much and to what extent, please be specific."
I see what you're doing here. You keep movng the goal posts. It's the same shameless tactic McCain used in opposing the repeal of Don't Ask Don't Tell.
a). the fact violent crimes are frequently commuted against gay people is an indication that the violent crime needs to be treated more harshly not an indication that violent crimes that involve gay people require special treatment
b). the fact some violent crimes against gays are not going through due process because of bigoted agencies of law enforcement, is not argument for increasing penalty for commiting those crimes (that doesnt even make sense)
@types10000 "the fact violent crimes are frequently commuted against gay people is an indication that the violent crime needs to be treated more harshly"
That's exactly what hate-crime legislation does.
"not an indication that violent crimes that involve gay people require special treatment"
Look back in history and you will see that you are making the same type of arguments that people like Strom Thumond made in opposing anti-lynching legislation.
@types10000 "the fact some violent crimes against gays are not going through due process because of bigoted agencies of law enforcement..."
Actually, I never made that argument, but now that you mention it, many times, even when reporting hate crime statistics is required by law, they are often under-reported.
And where were these same liberals when Jeffrey Curley and Jesse Dirkhising were killed? Oh wait, since they were murdered by NAMBLA, Democrats don't consider Jeffrey and Jesse hate crime victims.
So, how many of you mindless sheep support cutting aid to low income children & pregnant women, cutting pre-school programs, cutting aid to employment services, cutting aid to senior citizens, making it legal to murder doctors who give abortions, giving social security away to Wall St. gamblers, helping corporations keep campaign bribery legal, continuing the deregulation of Wall St., defunding the EPA - which will increase the cancer rates in the U.S. - and giving away more of our internet?
And this is how the criminals sneak in bills. Thank you Senator Demint for doing your job. That is all we ask of our elected officials. You are there to watch out for us. Shine on
@lastpatriot4America Your man DeMint is some great American. He voted against healthcare for 9/11 first responders JUST TO KEEP A TAX LOOPHOLE FOR MULTINATIONAL CORPORATIONS. How do you feel about that? Do you have more compassion for international corporations than for American heroes like DeMint does? Fuckin' pathetic.
@ncmedic3: Are you just pretending to be a pathetic asshole or are you actually sub-human? You want to help multinational corporations but not American heroes? Fuck you, you piece of shit.
@TheStulzRage i am serious. You sound like a typical liberal, you have nothing substantive to say so you just degrade people and shout profanities. I am a first responder(paramedic) and regardless of what ever happens to me on the job i would never expect the government to foot the bill. ESPECIALLY when we are BROKE!
@ncmedic3: Moron - did you even read the last comment I posted? What do you call that? It's a full comment on the reality of the tea party movement types (whether they call themselves tea party or not). It's a well organized group financed by Wall St. determined to destroy democracy.Period. If you support DeMint, you support multinational corporations over Americans. Period. Get it?
@lastpatriot4America Senator Demented is a dangerous bigot, who needs to get a good spanking, his mouth washed out with soap, and be thrown on the trash-heap of history, right along with the racist and anti-Semitic senators of the past.
I'm from Canada and I don't understand why we even have our ass hat hate crimes laws. The Human Rights Tribunal hauled Maclean's columnist Mark Steyn several times over his opinions against Islam that should be freely expressed in a nationally circulated magaine. Of course he's never been convicted of any form of hate crime and yet people who are offended can accuse someone like him and have him brought to face charges again. It's a complete waste of money and a violation of his freedoms.
@deathtrapdeath President Obama is a good and consciensious man--that must be why you hate him. If he was of the world the world would love him, but because he is not in the pockets of big business--like DeMint--the mindless sheep of the GOP are easily manipulated by special interest groups to hate him and believe any lie that comes down the pike.
@TheStrong32 Long since this post DeMint is of my list of candidates.
Obama expanded the war - currently involved in armed conflict against five middle eastern nations. Not including the drone attacks in several others. You must be off your medication or just graduated from a Liberal Arts College.
@deathtrapdeath Wow! You don't even know what a liberal arts college is, do you? Typical rabid right wing ignorance! Just because it contains the word "liberal" you assume it has something to do with left wing politics. You need a little education, my friend.
People better start focusing on what's important: Foreign entanglements halfway round the world, government and wall street corruption, the destruction of the currency through money printing, etc. Stop with all this petty identity politics crap. Your gender, ethnicity, sexual orientation isn't all that important. YOU may happen to THINK it's important. I'm just here to tell you to tell you...it's not.
If you commit a crime against some one you are going to get arrested anyway no matter what there orientation is already . Think about it. I live in a small hick town and if you go into a bar and push someone your going to get arrested no matter who they are . So what is the purpose of this bill . to long to explain. What they need to do is pass a bill to protect us against the politicians that ran this country into the ground, which would be about 99 percent of them.
Go read 1984 NOW!!! Because of this bill we are now going to have Thought Police. Obama is DAMN strait that I'm going to cling to my guns and my religion!
This bill is meant to provide protection of 2 groups, while neglecting all others. It is by far the most racist and devisive bill ever past since 1865. As a result, you will see revolution in this country . We have been so close for many years to war on our own soil, but this fuel will spark the uncertain, to anger, and the angry, to arms...
As a gay man, I agree that people committing a crime should not receive add. penalties because it is based on hate. Everyone should be treated equally when committing a crime. I do not support hate crimes leg..
Why does Sen. DeMint not support ENDA, which prohibits job discrimination in the priv. sector based on sexual orientation. People should be judged on their skills and not be denied a job or fired based on non-job related factors. Shouldn't equal treatment apply to employment.?
Liberals are happy that NAMBLA will now get special protection. Also, why are there no bills named after Jeffrey Curley or Jesse Dirkhising? How about one named after Channon Christian and Christopher Newsom?
People if Obama signs this he is a criminal & those in the senate that passed this bill last week are traitors and need to be arrested, The first amendment is our God given birth right and is to be protected by the government.
If it can be "taken away" than it is not a right. YOU HAVE NO RIGHTS!!!! You need permission to do almost ANYTHING in this country. Freedom is a LIE!!! We are all slaves. Get used to it, sheeple because you aren't going to get off of your lazy (most cases scared) asses and do anything about it.
yugmnivek , I agree with what your saying but only due to an illegal government that sits in D.C. & has been since Lincoln violated the constitution by not allowing the 7 confederate states to secede, a stipulation that they had under the constitution, each state has a status of individual sovereignty, D.C. was declared under Marshall law (loop hole) in order for congress to be called into session with the absence of the 7 and still is 2 this day. Think Henry viii, 500,000 dead Americans PS SOAR
@TVPlayground "Lincoln violated the constitution by not allowing the 7 confederate states to secede, a stipulation that they had under the constitution"
Where exactly in the Constitution is this "stipulation" located?
@TVPlayground "The first amendment is our God given birth right and is to be protected by the government."
That's right. And LGBT people have the right to be protected by the govrnment too. The first amendment forbids the government from using religion as a weapon to oppress any minority--including gays.
Screw the hate crime bill. Boo hoo! NO one commits a crime unless hate is involved. This is just a bill to take away our free speech. Wake up Americans. Queers, perverts and freaks have all the protection they need.
@sf3038 "This is just a bill to take away our free speech."
The bill doesn't say anything about speech, it is criminal BEHAVOIR that is affected. The passage of the Cvil Rights Act hasn't prevented the KKK or any other racist asshole from standing up and saying anything they want, short of obscenity, defamation, incitement to riot, and fighting words (rules that apply to every citizen equally). Under US law, any restrictons on the content of speech must face strict scruitiny.
@blueguise23 ...well maybe, but I agree with him here. This legislation is going to ultimately have nothing to do with gay rights, which I otherwise almost always staunchly support. This legislation in the future will be the basis for prosecuting those disagreeing with the state. This was not passed to protect the gays, it just has that appearance.
it is going to pass... the democrats will see to it.
And after that the percieved opinions will be crimes. If the courth thinks you were thinking racist thoughts, your life is over.
.
Especially noxious in a system filled with idiot cops. Still, they cannot toss every euro-american in prison, because then there wouldnt be anyone left to pay the freeriders.
.
No, the goal is fear and terror. To keep the population coved and afraid of speaking their mind on anything.
you're missing the point - the hate is an aggravating circumstance in ADDITION to the crime. you cant be prosecuted for just hating someone...the message is dont do the crimes, dont lynch people, dont beat fags, etc etc. However, I DO agree that there is a double standard where blacks and hispanics get to claim how oppressed they were. Fact remains though, that plenty of them are in jail, so dont act like they dont get prosecuted, because they do...
Afterall when you call somebody other than their name and then attempt to take it to the next level whereas you begin to initiate action based on what you feel is appropriate to the call of your order, you don't want to have to be held accountable for your actions (to 'certain kind of victims' not a person) for gods' sake...
People get law degrees to figure out the few exceptions to free speech, like yelling fire, inciting riots, etc. Hate speech is one thing, but hate used in the commission of a crime, especially violent crime is another and can be legislated, along with use of a yokelly-produced small-penis compensating bang-bang in the commission of said crime.
Anything can be legislated, most of the legislation just doesn't work. There are laws in place to deal with 'hateful' nature. If a crime is committed, one should not be jailed for the 'hate' but for the crime. This is tyranny because anyone could conceivingly be thrown in jail if it was a goal of another person, the police, or the government. Simply through hate, people will get their racial ex-bf or gf jailed for some written obscenity in an email, text, or recording. It's EVIL EVIL EVIL
that said, I do agree that the whole thought crime development in crime is not a good one. The problem is that the right wing is not willing to support its old position of no foreign adventures. I would consider being a republican if the right-wing would give up its love of foreign wars and fascist drug police....Ron Paul has the right ideas, but that libertarian no taxes for roads and schools nonsense is not workable....the real left hates authority - right wing find your way back...
Not surprising that a fag-hating christian flag-waving religious asshat from the part of the world with a violent amoral racist legacy second only to the Nazis would want to stop his racist folk from being prosecuted for what they do best, racist crime....not to say we dont have these racist white exports in the north because we do. Think of it this way klan members, at least the black and hispanic racists, and there are many, can get strung up too...
I suppose you aren't aware of a Christian pastor who was fined for "hate crimes" --speaking up for traditional Christian beliefs---in Canada. Do you seriously want to go down that road? As a lawyer who works in criminal law, there is *no* need for this bill. Anyone who cherishes civil liberties should be against this bill.
Tagging this HATE CRIME legislation onto the the Defense Authorization Bill is a crime in itself. What is Congress thinking of. Certainly not WE THE PEOPLE.
How ironic that the ones that appear to be for this bill are attacking people simply for thanking the Senator. They and are expressing some of the worst hatred and bigotry in their words that I've seen. Maybe they should be looking in the mirror when they say it...
What the senator is saying is true and we should be outraged at what the Congress is doing to this country. But the good senator has all the passion of a dead fish.
In the video below, Senator Jim Demint makes the point that so called hate crimes legislation destroys the concept of equal treatment under the law, by subtracting out non-privileged, non-minority victims, and treating them as less important based on their skin color, gender, or sexual orientation.
The more we continue to highlight our differences the more we will continue to focus on those differences. If the government would stay out of the issue society would stop being focused on differences. Pretty much the same as affirmative action. Perpetuates the attitude it was intended to eliminate.
If you beat someone's head in because you hate him, that's ok, we'll give you a few years in prison. But if you call that guy a f-- before you beat his head in, look out! that's a serious crime, and we'll have to add the GayAnal Bonus to your sentence.
I realize this is just liberal sissyness to lock up votes from interest groups, but isn't whether a crime is pre-meditated already factored in to the length of sentence? Which would cover deliberately targeting someone because they were a fruit
I think the Hate Crime Bill is against Christians in general. I do not hate anyone for their color, creed or sexual orientation, but I do hate the lifestyle of a homosexual, not the person himself. I feel he or she will answer to God for their lifestyle - not me.
any crime of violence is a hate crime. you dont assault someone because you love them. holder all ready said under oath that this law would be used to protect the historically discriminated against. so despite what your senators/reps say, the man who enforces the law has given us the criteria for enforcement. we dont need this law
you know there c1garet, most times, "christians" need to be persecuted. they've done such a great job of persecuting everyone not like them, it's time justice is served on them until they start acting as their christ asked them to.
until they follow the word of the true christ, not the one they made up, then i wholeheartely say fuck "christians"! you got that? need i say it more plainly for you there buddy? huh?
Nasty & ugly bill, this is. It keeps clergymen from preaching the Gospel. I also saw a headline recently that states that the Dems are saying "pass this bill or we won't pay the troops". I don't have it readily available so I can't say at this moment who exactly said that. Another sign of the times (biblical), IMHO.
I've been out of touch with the news lately ..has the Senate passed/shot down the Cap & Trade? I know Congress passed it.
I got just about beat to death when I was 19 for no other reason than for being white. Was that a hate crime, YES, do I think hate is something the gov has any business legislating? Of course not, I got a friend who thinks men with facial hair are all theives, its the same thing, if it causes a crime then that is a crime, disliking someone for whatever reason is called being a human.
Regardless of what anyone thinks of hate crimes legislation, it should not be tacked on to a bill to which it has no relevance. There's the real g-d crime, and our legislators are the criminals!
This comment has received too many negative votesshow
Why oh why isn't this senator trying to defend the rights of Ku Klux Klan pastors to preach what they want? Why doesn't he mention the Ku Klux Klan? Because it doesn't fit his agenda?
What, The Ku Klux Klan cant be prosecuted because they kill BLACK people, its because they kill human beings. Race has nothing to do with the crime. You should try to be more informed of you opinions before you post them.
This comment has received too many negative votesshow
Of course he can't see the rampant prejudice and discrimination. He's white, male, etc ,.... LOL He doesn't want to share or lose his special status quo...
It's so nice to know that we actually have somebody on the people's side in the Senate. Now to get more into office that are actually for the people and our Country.
This comment has received too many negative votesshow
what' people's side? be specific? you mean the southern bigot's side there ralyns. do me a favor, speak for yourself, not for the country. cause in actually you don't speak for anyone but yourself, you god damned ignorant bigot!
Thank you Senator DeMint for speaking out, and upholding the principles of this great country of ours. Our country would be a far better place if we had more people like you serving us in our government.
This comment has received too many negative votesshow
yeah, our country'd be better served if we had more southern bigots upholding the principles, not of the constitutution, but of their own religious hate for those not like them.
i wouldn't trust the US constitution with any southern bastard, there phyllbo02. they're all about ignorance, intolerance, bigotry & religious hate. don't believe me, check their glorious history & legacy up to & including gena 6.
you're stupidity's a bad omen for this country & you personally disgust me.
yes, we see how the 14th amend. was followed to the T by southern "christian" bigots.
that's until the feds step in every time, to remind those ignorant, intolerant, bigoted "holier than thou" bastards it exists.
now if those same southern bigots, who hate blacks (& still do), jews, gays & now muslims, believed in euality, then we wouldn't need anything but that amendment.
unfortunately, they just don't give a shit about it. only they, the "real white trailor trash" believe they have rights.
Wow wntoply, it is nice to see you are not a hateful person. I'm sure Martin Luther King would agree..... Hatred is a bad thing no matter who portrays it, that includes you. You spew as much hatred as the kkk. What are you, a member of the modern black panthers?
This comment has received too many negative votesshow
jadam, i only give back what i'm given.
i hate as well as i'm hated. but to clarify & for your edification, i only hate southern "christians" who hate me, a gay man, or blacks, jews, muslims or anyone else who doesn't agree with their demented "religion".
now, to hate those who want to deny me rights GUARANTEED BY THE THE CONSTITUTION OF THE UNITED STATES OF AMERICA, i think is down right reasonable, don't you?
but then, i bet you're prime example of that southern"christian" bigoted hate.
Ok wntoply, let me clarify my position. I am christian (not sothern) that believes it is generally wrong to hate people but not there action. I don't support the gay lifestyle but have had MANY gay friends. Marriage is a religious institution. If a state agree to civil unions that's fine with me. I believe in equal rights for all not equality of out come. MLK and Gondi were hated men but look at the changes they made with out violence and hate.....
jadam your wasting your time talking to wntoply he's a racist atheist who hates anyone thats not gay, black or atheist. He doesn't care that he is full of hate and that the southern churches is where the civil rights started. He just hates you. Some people just want to be treated bad.
Truthinmidamerica, you could be right but I don't think it hurts to try. He must, in the end find his own way, where ever that may lead. I only hope some day he can find peace in his life : )
wntoply, to assume me as a bigot is intellectually dishonest. And to asume the same of all sothern christians is as bad as asuming blacks are lazy ans should be slaves, its just wrong.
Groups should not be singled out for speical treatment. There are already laws that exist that cover these hatreds. Thats all Sen. Demint was pointing out. Besides giving the government more power is always a bad idea. As you can see today everything they touch gets screwed up any way. I hope things go better 4u

@TheStrong32
"Before you make public comments it would be a good idea to actually do some research on the issue, OK?"
- i have done the research and that is why you are forced to make assertions like that instead of addressing my actual arguments
"Hate crimes--by DEFINITION--are specifically BIAS-MOTIVATED violence" - you have failed to identify any objective for determining bias. ie. why is crime against a rich person (because they are rich) not a hate crime whilst a crime against gays is?
types10000 7 months ago
@types10000 " have done the research"
I sincerely doubt this; if you had, you would not consistently fail to correctly define what a hate crime is. If you have, then that means you are intentionally and purposefully misrepresenting the matter--a typical ploy of the anti-gay agenda.

"I sincerely doubt this; if you had, you would not consistently fail to correctly define what a hate crime is"
again, if that is the case then please define it for me, i'd be very interested to see a definition that doesnt commit the slippery slope fallacy by being so vague that virtually any group could come under it eg. the rich, computer programmers .etc
types10000 7 months ago
@types10000 "i'd be very interested to see a definition that doesnt commit the slippery slope fallacy by being so vague that virtually any group could come under it "
Well, yes. ANY group which becomes victimized by hate crimes--i.e., crimes committed against them BECAUSE they belong, or are peceived to belong, to a particular group--should be eligible for protection by hate-crime legislation. This isn't a "slippery slope;" it's the law adapting itself to evolutions in criminal behavior.
TheStrong32 6 months ago
@TheStrong32
"This isn't a 'slippery slope;' it's the law adapting itself to evolutions in criminal behavior."
- no, it IS a slippery slope, refer to my example regarding computer programmers.

@TheStrong32

"No. It is PRECISELY the point. "
no my dim-witted friend because as has explained to you several times now:
- the fact the crimes are not being pursued by law enforcement agencies due to bigotry does not have provide a justification for beefing up the penalties of those crimes
ie.
if the crimes arnt being perused then beefing-up the penalty via hate crime legislation DOESNT MAKE ANY SENSE
types10000 7 months ago
@types10000 I really don't know why you insist on going off on this rabbit trail about law enforcement agencies. It has nothing to do with what I was responding to. When I said, "No it is PRECISELY the point," I was responding to your assertion that no history of societal bigotry and violence against computer programmers--as opposed to overwhelming evidence of bigtry and violence against racial and sexual minorities--was irrelevant. I never said ANYTHING about law enforcement agencies.

@TheStrong32
"as opposed to overwhelming evidence of bigtry and violence against racial and sexual minorities"
i already addressed this as well:
- It is essentially saying that what determines it to be a hate crime is the fact lots of people are doing it
- For this line of reasoning to hold up you need to be able to objectively specify HOW BIGOTRY towards computer programmers .etc would be required for it to constitute a hate crime. eg. 100 murders
types10000 7 months ago
@types10000 Hate crimes are defined in federal law as: "crimes that manifest evidence of prejudice based on race, gender and gender identity, religion, disability, sexual orientation, or ethnicity, including where appropriate the crimes of murder, non-negligent manslaughter; forcible rape; aggravated assault, simple assault, intimidation; arson; and destruction, damage or vandalism of property. " (28 USC 534, Notes: Hate Crime Statistics).

"just because a person happens to be a member of such a group doesn't mean every crime against him is a hate crime"

"it depends on the circumstances." - by which you infact in depends on the subjective feelings of those who hear about it.

- we've been down this road before, i asked to present these alleged facts and you couldnt, all you did was point a case and say 'the facts are in there'. you have an appeal to authority but no facts to speak of.
types10000 7 months ago
@types10000 The facts of the CASE. OK? It is determined on a case-by-case basis. That's how the law works. The law prescribes specific penalties for specific acts. When someone is accused of violating the law, the prosecution and the defense present evidence; then the jury (or judge, if the defendant waived his right to trial by jury) is the TRIER OF FACTS. If they decide that the evidence shows that the accused commited the acts, he or she is found guilty. The facts differ from case to case.
TheStrong32 7 months ago
@TheStrong32
No, there is a basis for determining whether it is.
types10000 7 months ago
@TheStrong32
since you seem to have trouble getting your head around my first hypothetical, i will change it:
If a crime committed against a gay person (Motivated by the fact they are gay) is an attack on everyone who is gay then so too is a crime commited against a computer programmer (motivated by the fact they are a computer programmer) an attack on everyone who is a computer programmer.
what is your objective justification for one being a hate crime and not the other?
types10000 7 months ago
@types10000 You seem to have trouble getting your head around the idea of a hate crime. There is no history of societal bigotry and violence against computer programmers. You're just making up stupid examples to be cute. Gay bashing is a serious epidemic in this country. Hundreds of American citizens are attacked every year for no other reason than because they are--or are percieved to be--LGBT. And a number are murdered in the most horrific manner. The purpose is to terrorize the entire group.

types10000 7 months ago
@TheStrong32
Also:
a). the fact violent crimes are frequently commuted against gay people is an indication that the violent crime needs to be treated more harshly not an indication that violent crimes that involve gay people require special treatment
b). the fact some violent crimes against gays are not going through due process because of bigoted agencies of law enforcement, is not argument for increasing penalty for commiting those crimes (that doesnt even make sense)
Try a little logic.
types10000 7 months ago
@types10000 "the fact violent crimes are frequently commuted against gay people is an indication that the violent crime needs to be treated more harshly"
That's exactly what hate-crime legislation does.

you're missing the point - the hate is an aggravating circumstance in ADDITION to the crime. you cant be prosecuted for just hating someone...the message is dont do the crimes, dont lynch people, dont beat fags, etc etc. However, I DO agree that there is a double standard where blacks and hispanics get to claim how oppressed they were. Fact remains though, that plenty of them are in jail, so dont act like they dont get prosecuted, because they do...
TheRealCritique 2 years ago 4
The Hate Crimes Bill is unconstitutional.
Afterall when you call somebody other than their name and then attempt to take it to the next level whereas you begin to initiate action based on what you feel is appropriate to the call of your order, you don't want to have to be held accountable for your actions (to 'certain kind of victims' not a person) for gods' sake...
mwc1954 2 years ago
People get law degrees to figure out the few exceptions to free speech, like yelling fire, inciting riots, etc. Hate speech is one thing, but hate used in the commission of a crime, especially violent crime is another and can be legislated, along with use of a yokelly-produced small-penis compensating bang-bang in the commission of said crime.
TheRealCritique 2 years ago
Anything can be legislated, most of the legislation just doesn't work. There are laws in place to deal with 'hateful' nature. If a crime is committed, one should not be jailed for the 'hate' but for the crime. This is tyranny because anyone could conceivingly be thrown in jail if it was a goal of another person, the police, or the government. Simply through hate, people will get their racial ex-bf or gf jailed for some written obscenity in an email, text, or recording. It's EVIL EVIL EVIL

The more we continue to highlight our differences the more we will continue to focus on those differences. If the government would stay out of the issue society would stop being focused on differences. Pretty much the same as affirmative action. Perpetuates the attitude it was intended to eliminate.

What, The Ku Klux Klan cant be prosecuted because they kill BLACK people, its because they kill human beings. Race has nothing to do with the crime. You should try to be more informed of you opinions before you post them.

Of course he can't see the rampant prejudice and discrimination. He's white, male, etc ,.... LOL He doesn't want to share or lose his special status quo...

EQUAL PROTECTION yes! Any other is UNequal protection thus UNfair and UNjust... "UNequal balances are an abomination"
Thank God he is EXAMINING the bill, theres always abuse justified by the wording contained therein.
Exactly, there no such thing as a criminal THOUGHTS but only criminal ACTS.

THANK YOU!
It's so nice to know that we actually have somebody on the people's side in the Senate. Now to get more into office that are actually for the people and our Country.

Thank you Senator DeMint for speaking out, and upholding the principles of this great country of ours. Our country would be a far better place if we had more people like you serving us in our government.

yeah, our country'd be better served if we had more southern bigots upholding the principles, not of the constitutution, but of their own religious hate for those not like them.
i wouldn't trust the US constitution with any southern bastard, there phyllbo02. they're all about ignorance, intolerance, bigotry & religious hate. don't believe me, check their glorious history & legacy up to & including gena 6.
you're stupidity's a bad omen for this country & you personally disgust me.
wntoply6 2 years ago
You speak of the Constution? Try reading the 14th amendment. How is the hate crimes bill equal?
jadam914 2 years ago
yes, we see how the 14th amend. was followed to the T by southern "christian" bigots.
that's until the feds step in every time, to remind those ignorant, intolerant, bigoted "holier than thou" bastards it exists.
now if those same southern bigots, who hate blacks (& still do), jews, gays & now muslims, believed in euality, then we wouldn't need anything but that amendment.
unfortunately, they just don't give a shit about it. only they, the "real white trailor trash" believe they have rights.

Wow wntoply, it is nice to see you are not a hateful person. I'm sure Martin Luther King would agree..... Hatred is a bad thing no matter who portrays it, that includes you. You spew as much hatred as the kkk. What are you, a member of the modern black panthers?

jadam, i only give back what i'm given.
i hate as well as i'm hated. but to clarify & for your edification, i only hate southern "christians" who hate me, a gay man, or blacks, jews, muslims or anyone else who doesn't agree with their demented "religion".
now, to hate those who want to deny me rights GUARANTEED BY THE THE CONSTITUTION OF THE UNITED STATES OF AMERICA, i think is down right reasonable, don't you?
but then, i bet you're prime example of that southern"christian" bigoted hate.
wntoply6 2 years ago
Ok wntoply, let me clarify my position. I am christian (not sothern) that believes it is generally wrong to hate people but not there action. I don't support the gay lifestyle but have had MANY gay friends. Marriage is a religious institution. If a state agree to civil unions that's fine with me. I believe in equal rights for all not equality of out come. MLK and Gondi were hated men but look at the changes they made with out violence and hate.....
jadam914 2 years ago
jadam your wasting your time talking to wntoply he's a racist atheist who hates anyone thats not gay, black or atheist. He doesn't care that he is full of hate and that the southern churches is where the civil rights started. He just hates you. Some people just want to be treated bad.

Truthinmidamerica, you could be right but I don't think it hurts to try. He must, in the end find his own way, where ever that may lead. I only hope some day he can find peace in his life : )
jadam914 2 years ago
wntoply, to assume me as a bigot is intellectually dishonest.
