The Congressman wants to allow the states to decide if they want to legalize personal habits that only involve a person's own self, whereas murder and rape involve harming other individuals. If you were forcing someone to harm themselves by injecting something into another person then clearly you should be incarcerated, but if you are smoking marijuana in your own home then that should be fine.
