Both the ped and the driver at fault. What a dumbass for walking on a highway AT NIGHT! and the driver could have probably swerved, but I wasn't there so...IDK
it was on TV and discovery got the whole version and it showed the guy had more than a few to drink. i will admit that it's not smart to walk on a freeway but there's not really an excuse to hit a person (no matter who's legally/financially at fault) - not to mention the driver was so drunk he didn't even know what happened...he would've went home none the wiser.

Are you sure it wasn't the person walking that was drunk and not the driver? He shouldn't be walking on the freeway anyways.
