The court does have to take in account that humans have a natural response when they feel threatened, a "Fight or Flight" response. So claiming a pre-emptive strike when you felt threatened with violence can work, especially with this video because clearly the bloke in green was in his space and clenching his fists when the other tried to keep him away with his arms without backing down.

@actually I think the court would determine whether its assault or self defence precisely on how they "look at it" - you are quite wrong to say that perspective itself in legal matters is not relevant
you do not have to let someone verbally threaten you or enter your space, you do have the right to preemptively strike someone should you feel an attack is imminent - but you may well be asked to justify your actions in court

It's as simple as that. Actually, far from having a short fuse, I think the first guy showed remarkable patience, trying to talk the other one down and avoid a fight, and when this wasn't possible, he ended it in the quickest and safest way possible. The court does have to take in account that humans have a natural response when they feel threatened, a "Fight or Flight" response. So claiming a pre-emptive strike when you felt threatened with violence can work, especially with this video because clearly the bloke in green was in his space and clenching his fists when the other tried to keep him away with his arms without backing down.

@actually I think the court would determine whether its assault or self defence precisely on how they "look at it" - you are quite wrong to say that perspective itself in legal matters is not relevant
you do not have to let someone verbally threaten you or enter your space, you do have the right to preemptively strike someone should you feel an attack is imminent - but you may well be asked to justify your actions in court

@hornywhitehottie The courts don't care who threw the first punch, they care about the time between the assault. Self Defense doesn't mean he has to hit you first, it means you used the apprppiate force in a situation that a reasonable person would agree to. They look at why the fight happened, was it reasonable to fight back, did you start it, or did he start it. Many factors.
The Justice system isn't black and white.

He most likely has a knife hidden away in his pants, and his buddies are huddled around the corner, ready to spring to his aid should he run into any trouble. His reputation as a "patsan" (Russian "homey") is on the line, so he is prepared to do anything to complete the mugging, including killing the victim if need be. The other guy does what he has to do.

I've seen people pulling knives out and running away, cause they are scared to use them. Of course we don't know what happened before they started filming, but one of my friends said he knows the guy in the black jacket and he got a short fuse.

It's as simple as that. Actually, far from having a short fuse, I think the first guy showed remarkable patience, trying to talk the other one down and avoid a fight, and when this wasn't possible, he ended it in the quickest and safest way possible. Who can blame him?

I disagree that this is a perfect pre-emptive strike. His technique is good, but the situation could probably have been avoided or de-escalated. Too much ego involved in both. And closed fist strikes often lead to broken metacarpal bones in the hand.
