The parents have insurance but the insurance company refuses to pay? This happens all the time It's called 'rescission'. The parents thought the insurance company paid the bill. They usually don't know they owe until they check their credit report.

  • I have a student loan that the debt collector is chasing me for. I paid on it for ten years without missing ONE month then lost my job an started having problems finding a job paying as much as I was making before. when the debt collectors found me I told them I was willing to start paying the same amount I was paying the lender before I lsot my job but they try to tell me they want more than double that amount. I told them 'fine chase me'. now they been looking for me for 3 years..

  • Wow, thats intense. I am a debt terrorist, but I have never harrassed anybody. I guess the collection industry operates a little differently in New Zealand. We chase debt from people that owe creditors money. We provide a professional service to both our client and debtor. We concerntrate on debtors who owe money but wont pay, not cant pay, big difference. If a debtor cant pay, its up to the creditor to decide on how to proceed, not the collector. Professionalism & empathy is key.

  • How do you become a prepaid legal associate? I can be so naive. When I first got calls from Mel S. Harris, I freaked too much to think about verification. I paid, became unemployed, husband's hours were reduced. They put a judgment against me without sending a summons. Sometimes things happen to people. If we are to stop borrowing money, then that includes most of the nation. I am trying to improve myself by going to college for criminal justice. I hope to help others in my shoes one day.

  • I got a question I had a Law Firm call me on my Debt from a Gym Contract and I looked up the # they gave me as well too They do not show up on my caller ID and I looked up the Lawfirm name and such and they where telling me I will default by the court of Law and I do not live in that state anymore and then he Left me another Harassing Call telling me Its in my Best Intrest to call them Back???

    Is that going against my Rights??? and Im currently Unemployed and he told me that is no exuse

  • My checking account was liened and garnished by a Chicago collection agency. The woman who processed it enforced it without a summons (I moved...wasnt at my old house to recieve it). The second my tax money was deposited, I couldnt touch it. They summon EVERY SINGLE BANK IN THE STATE AND IT IS A COURT ORDER LIEN...you cannot run from that. Oh, and im also a bill collector. It was funny to be on "the other side" so to speak.

  • Thank you for this video. Debt collectors are out of control, and I used to be in collections! I am a finance professional who volunteers at a free finance office for people who can't pay my normal fees. Some of the stuff I have seen lately, is clearly over the line. I helped one individual prove that they didn't owe a bill they already paid, but the collector still kept calling?! There have also been several people hounded for the debts of their dead relatives, that they DO NOT owe!

    My facts are straight and based on the FDCPA, FCRA, and many other Federal Laws. I used to battle Law Firms everyday when I worked at a Bankruptcy Law Firm myself.

  • @Demolitionhick, Excellent question. Yes, Debt Collectors (or any person) can 'file' a 'Complaint' with the Court against anyone else.

    Debtors can file a Lawsuit against Debt Collectors and 1st Party Creditors as well.

    In my experience at a Bankruptcy Prevention Law Firm, I've seen frivolous Lawsuits filed by Debt Collection Attorneys a few times Thanks.

  • @Reggiebraz: the "Burden of Proof" is on the Debt Collector. Under U.S. Law, the DT has to provide the proof - not the Debtor (you should know this already) But I'm happy to inform you:)

    Being a DT is not honest work! There may be some honest ones, but they don't last long in that work.

    Many DT's are in denial about what they do.

  • Yes you are correct the burden of proof is on the agency IF the debtor reqest proof in writing within 30 days. But, let me inform you, the vast majority of debts that are placed in 3rd party agencies are legitimate. While there are some unethical collectors and agencies, just like there are unetical debtors (credit criminals) the majority do follow the law. By the way in most states calling neigbors or family to leave a message is legal as long as the debt is not discussed.

  • Bitworm05, Suppose you brought a Black Boxer for say 3,000. You took it home and fell in love with it. After 30 days you learn that the seller charged you 3 times what you agreed to pay ($9,000).

    You weren't expecting to be charged that amount and because of that (or job loss) you can't afford the new higher debt. This happens to unsuspecting Consumers all the time.

    Next let's say that you're a Big Bank or Credit Card Company (eg Captial One) who just got a Gov Bail-Out? Why? Any answers?

  • People buy stuff without reading the agreements all the time. We tell people to have all contracts reviewed by an Attorney. If you would just open your mind and learn about what were saying, I'm sure you'd agree. But until you come around....

    We are not trying to get over. The Banks have beat us to the punch with the bail-out. We teach people how to responsibly pay their debt (only what they do owe).

    Fact: Many DT's use dirty tricks like putting false information on Credit Reports.

  • It is legal for a bill colector to call. 1st of if you owe anyone money you have to pay it. If you dont that company that you owe can take you to court.   • besides, you seem to think that agencies make up debts that people dont owe...they dont need to, there is more than enough legit debts for companies to collect on, why would we make up fake ones? it is wrong to call neighbors and disguss debts, it is legal in most states to call jobs, and call between 8 am and 9 pm as long as you onlt call once, and you can call other people but cant disguss a debt, the only letters sent are bills, it is illegal to threaten jail, but pre-legal debts will be sued

  • Yes. Companies do make up debt. It's a form of I.D. Theft. It happens all the time. There are legit accounts to collect on. We show our clients how to work with you folks, in their own best interest.

  • ok well if they make up debts its not something i know about or am any part of i dont want to do anything to further their wrong-doing...i think what some collectors and companies do are awful, if somone tells me they dont owe something i make sure to get them the proof within 30 days, i havent run into any made up debts yet, not to say that doesnt happen...i am watching more of your vids, i shouldnt have said u are wrong, these vids are great for people who are getting tricked by companies

  • Ok i am a bill collector, before our company even calls any debtor we make sure we sent a letter to the address expressing exactly why we are going to call...aka proof that they owe a debt. secondly no they dont us us directly, but if i asked my brother to call my friend and ask him for money he owes me because i am busy and dont have time to call myself, that makes my brother a terrorists?? you guys do EVERYTHING wrong and you are pretend you are education.. i do like that u respond to comments

    Sending a letter is no proof of any debt, you know that. I get mail all the time at for people who no longer live at this address and who are not at all related to me. People I don't know.

    Usually the Debtor in question doesn't owe you at all. You have no business profiting of off peoples pain. You've never attended any of our courses, so how would you know what we do? You're too biased. Thanks.

  • Debt terrorists ? dont you think that's a bit extreme ? You should make something clear, that technically the debtor doesn't owe the collector but the collector is calling on behalf of a company which you do owe money too (unless it is fraud obviously) People should stop borrowing money they don't have. I find in the U.S. that people seem to love getting and spending the money but don't like paying it back....

    you're Canadian? Are you living in the states? If you are and you have a credit card, have they "stripped" your available balance yet?

    Finally, APR's are being raised to the extreme. People's rates are being raised forcing them into debt. It's not the borrowing, it's the lenders jacking up rates.

  • Imaguglielmo, we agree. It's best to not borrow money at all. But you haven't done your home-work. Fact. Businesses use money that they can't pay back too. This is why there is a "credit freeze" in the markets and Bail-outs for big businesses. Humm, what about that?

    How about this? force the Debt Terrorist to Prove what is owed. Many-times mysterious fees are placed on 2nd Party accounts.

    What if collector started calling you about money you owed your parents? They obviously wouldn't have any business calling you about money you owed someone else.

  • I just have to say, as an objective 3rd party, that this is mostly really bad advice. I am not a debt collector nor am I a debtor that has defaulted on debt. I do have intimtae knowledge of civil court procedures in all states and I see credit card judgements leveled and enforced 5 days a weeek. On Friday there was 17 small claims credit card cases. 16 ended in a judgement for the plaintiff (the creditor or the credit card company). We didn't get to #17.

  • Nice way to try and scare people. We provide "information" about our Rights as American Citizens - not advice.

    You failed to mention (as one whom claims to know) that the biggest reason why judgments are "leveled and enforced" is because people can not afford a Lawyer, or are intimidated and not aware of their Rights as "defaulted debtors".

    You also forget to inform people that in small claims court, there usually is a mediator before you meet the judge.

    Don't be scared - be prepared.

  • Let's not forget the bottom feeders that buy up old debts from companies who probably by now have already written it off as loss on their taxes long ago.   • recently saw 3 big! debt collectors turn up at a location turns out that there was identy fraud and they had the wrong person. the debt guys tried to remove a items from his house wrong move as his family where at the location for a party 12 big ex/reg army at on point a saw debt guys teeth fly out, one had a broken nose+leg+arm they third ran but was caught they draged him back to his van smashed that and him inside it and that poor bastard still in hospital. These 3 debt guys where huge

  • I understand why everyone is buying into this. Many of us are in debt and we want someone to tell us its ok not to pay our bills. But we know that its not ok. We know that we sign contracts agreeing to pay later for goods and services recieved. Then later comes and we can't adhere to the agreement. The creditor, however, can and does. This results in everything from letters to liens and should come as no surprise because WE signed for it. Best way to stop a bill collector, PAY YOUR BILL!

  • debt collectors buy old debt for pennies on the dollar, and call/send letter that states they do have authority without ever providing the backup paperwork and seek to collect, they double the amounts originally due, so $500 can become $1000 and they can freeze your assets for double that. so $500 can become $2000 and you should never ever pay them. they are the maggots of the legal/debt industry and they know it. they make me sick and lie. no one owes them a f**king dime - demand proof!!!

  • You don't have to have debt to live in America. In fact debt as we know it didn't start until the 1920's. In 1913 the Federal Reserve Act was signed that changed the American economy.

    There are many issues and Laws surrounding Debt and Credit. The Federal Reserve Act is a DIFFERENT Law that from the FDCPA.

  • Luxury, clothing, salon services, cigarettes, fancy coffee drinks, dining out, cutting edge communication/media services, illicit substances, alcohol, "beyond your means" housing, driving a car instead of taking the bus, etc etc . ! Live simpler, plainly, and humbly until you pay off your debts and can afford all of those luxuries. It is the excessive debt defaulter that ultimately makes my interest rates higher, and that makes me ill.

  • I agree with most of your points about living below your means. But it's not only the excessive defaulter who makes your rates higher. Many Creditors raise rates because they know that debt management is a daunting and confusing task.

  • MMATHIA00 is a debt collector. Don't listen to him. Debt collectors rarely can prove you owe anything. Hire a consumer lawyer. They can usually make the debt disappear even off your credit report.

    You lie when you say that they don't leave theatening msgs. That's why there is a U.S. Federal Law called the Fair Debt Collections Practices Act [FDCPA]. Consumers CAN be awarded damages of up to $1,000 for each violation of the [FDCPA].

    Fact moron: 75% of Credit Reports have ERRORS and FALSE information on them. 25% of these errors damage peoples credit standing. Thats why there is an FCRA!

  • Be careful if you are applying for a federal job, it is much easier to garnish your wages for debt collector. Make sure you look at your credit report before you apply for any federal work, so you can find ways to not get you pay garnished.

Can you grab a pencil and figure out what a home loan cost with a 6% loan rather than a 5% loan. why don't you do a video on how much money you cost someone who wants to improve thier life. instead of screwing it up.

    I analyzed a $200,000 Loan at 5% and 6% with a minimum payment of $1,005 every month.

    At 5%, you'll pay a WHOPPING $363.368 in INTEREST 626 months.

    At 6% expect to pay an OUTRAGEOUS $868,637 in INTEREST! 1,064 months.

    Pay MORE than the minimum payment if you can?

  • I am currently trying to get out of debt right now using the dave ramsey debt snowball. However I am the one who put myself in this situation. I realize the point you are trying to make in this video. But even though harasment is against the law, am I not morally obligated to pay these off? Thank you. Good message by the way.

  • I like Dave Ramsey's' ideas and opinions and moral teachings, but I also disagree with some of his suggestions (i.e. cutting up or closing credit cards). As a Professional Credit Card Negotiator, I know that closing an account hurts your credit score because length of credit history makes a major impression to lenders.

  • Debt Collectors are required by Law not violate the Fair Debt Collections Practices Act [FDCPA]. What do you call a person who willfully violates the Law? Answer: a Low-Life.

    The FDCPA leaves plenty of room for Debt Collectors to collect trillions of dollars of debt.

    There is no need for anyone to violate the law to make a living. Once you cross that line WE consider you a Debt Terrorist.

IT IS AGAINST FEDERAL LAW FOR COLLECTORS TO CALL YOU AT UNUSUAL TIMES OF THE DAY, and yet so many times they get away with it because they are so intimidating. THE LAW IS ON YOUR SIDE MY FRIENDS, YOU ARE IN CONTROL OF YOUR MONEY NOT THE COLLECTORS.

  • It sucks I wish I would have seen this movie before. What do I do when I've already committed to a payment arrangement, but defaulted on them. See there is one benefit in working at a collection agency, it's that I know all the little inside tricks collectors use. I also always help my family members write disputes to collection agencies. But what if it already is verified that I owe the debt, and I've already committed to a payment plan?

  • You did the right thing by settling this debt. Next time, "Validate" the debt before you agree to make any payments. This will prevent them from overcharging you for the account.

  • Yea I have another collection agency after me now, I downloaded the CCDV letter, This is an attempt to correct your records any informatin obtained will be used for that service, haha I love it!

  • people need someone to guide them through there issues when it comes to dealing with credit ... however i have seen a lot of third party companies who give advice and take peoples money and it doesnt make there situation any better ..... i hope u guys arent like that and u are doing a good service to the people .... however calling people idiots and terrorists seems like you are doing the same thing you are trying to fight against .... that being name calling and demening people ....

  • Where did you get that from? We never said that. You should pay what you owe. But sometimes you don't owe the debt. For example, when your insurance company denies coverage for no reason, you're stuck with the bill. Then the DR sells it to the Debt Terrorist and you're like "wait" I have insurance, why do I have to pay for this.

    Debt is about more than credit loans.

  • alright.... this video makes valid points .... however i am pretty sure this guy is looking to make some money off of his 'knowledge'..... a few points here ... most debt agencies have lawyers and if the client allows it legal action can be taken against you if the debt is big enough and some collectors can recommend legal action ..... however want some free advice???? ask for the collectors agency address and send in a cease and decest order and they cant call you anymore. Or pay your bills

  • If someone owes you money they should pay. You don't sound like a 3rd Party "Junk Debt Buyer" [aka Debt Terrorist].

    Try sending them a letter requesting payment. If they don't respond send a letter demanding payment.

    But don't charge excessive interest and fees retroactively and we won't consider you a Debt Terrorist.

  • I had a debt collector called an said that they were an attorny an said i ow ed a debt from a credit card so i told them show me proof that i owed this debt

    i need to see recipts signed by me from every transaction .They said they didnt have too show me any proof lol ..so i told this dude who claims he was a lawyer for the collection agentcy. contact my lawyer that my lawyer was waiting on his call

  • listen i am a debt collector by choice...i love my job...there is nothing illegal about what i do...the problem is all the people out there that run from their responsibilities!!!! sure there are people who actually do have a good reason for stopping payment on their loans or credit cards and those are the people that do the right thing and make arrangements to repay what they owe...then there are the people that are complete scumbags and open things and make the minimum payment one time.....

  • I've seen many of your other videos and I liked them, but this one made me a little mad.. I was a collector for a mortgage company, and many of the things mentioned here did not apply to us, like payment/bonus did not depend on ammount collected, And by no means we tried to intimidate people, just trying to see what the problem was and tried to help them if we could, however we still got many responses of people full of rage and this kind of videos will make more people have similar responses.

  • debt collectors can speak with the debtors spouse in 46 states i believe. of course its urgent for them to pay,9/10 debtors have money and have had money to make payments on there accounts and never do, then collectors call them and they scream at them, threatening there personal well being. But thats ok right

  • At .47 Not true, the collector can speak with your spouse except in Alabama Iowa and Mass in ALL other states the spouse is considered "consumer which means any person obligated or allegedly obligated to pay any debt.

  • Correct, our Federal Reserve system has always been set up to lead the American People into lives of credit and debt. The government wants us in debt so we can be controlled easier. However they can only do that if the American people submit into the plan. If you buy things you cannot afford you are sure to loose. Sign up to free credit report to make sure your not surprised by a "debt terrorist." I understand the truth. We need to read things before we sign them. Most don't and cry about it.

  • so lets say sombody buys a car and they make timely paymets for about a year or 2 they lose their job or have a problem paying the car...they decide to give it to the bank or get it "repoed" and a debt collecter calls you and tells you you owe them a ridiculous amount of mony even tho the bank sold the car off and made 3/4 of the mony back? so now your paying for somthing you dont drive anymore and that makes you the scumbag?

    That person is still responsible to pay that debt back. But they can negotiate for a settlement on that amount.

    They are not dead-beats.  They've found themselves in a bad debt situtation.

  • I have a strange point to make in response to your video.....UM THEY OWE THE MONEY!If someone borrowed money from you,wouldn't you want it back??Give me a break! I'm a collector,I collect credit card debts, they're the worst because ALOT of the debtors I deal with ran up the bill KNOWING they weren't ever going to pay the 15 thousand dollar account,how fair is that to the american public that pay attention to thier finances and pay thier bills? we end up paying more because of them.   • Rick Silver co-heads a large debt-collector agency, NCB in Pennsylvania. They have a staff of low life who will torment the everyday Joe who finds himself in issues, loss of job, health, etc etc. They don't care. They want their commission on what they can get. They have no life other than making sure they are as rabid as possible. This is a sick profession to be in. And NCB Collectors have to be at the top of the crud list.
