Ben Franklin wasn't wrong at all. You're confusing liberty for freedom. Liberty is freedom fro despotic rule. Having the "freedom" to kill someone without getting arrested is not liberty at all. The presence of the police force is to preserve rights insofar as they do not inhibit the rights of others. That is the liberty Franklin was discussing.

If bonavex had, you could easily dismiss him/her based on precedents in the right against unlawful search and seizure or the right against self-incrimination, both of which corroborate your view of Ben Franklin's liberty.
