Rewatch the video please, you will clearly see that kobe is still trying to set the screen after contact has been made - that means he never got into position. He never gave room for Sergio to take a step around him which means it was an illegal screen. I believe he pushed off on sergios chest, not through a push with his hands but with his forearms.
