think of them as identical twin brothers...Basically the same, but with subtle differences that make them their own. If that makes sense. Jailbreaking will void your warranty but restoring your iPod instantly will revalidate it. It your iPod touch is frozen get a tool like ZiPhone and put it in recovery mode so you can restore it. You also SAVE money because you can just download the iPhone apps instead of buying them from Apple.

ive got both and i think that the touch has got a slightly smoother screen and the colors are more full. the iphone makes up with its functions. i was disapointed though, becasue i opended my touch and it came with two obvious flaws/scratches on the screen.
