  • Has anyone caught the Fox news argument on torture? whenever the goverment is accused of torture by a guest on Fox news, the pundits call the assertion out of line and untrue, but then moments later, they turn around and defend the use torture saying liberals are too soft on criminals, so if accusing our goverment of torture is a nasty far-left attack, but if they did use torture its ok if it means defending our rights?

  • Jed - interesting take on the War Powers Act - but it's never been challenged, and I don't think it really will be. The President will not challenge it because it allows him to put troops into hotspots with just a resolution and not a declaration of war. Congress will not challenge it because it allows them the ability to remove the resolution and require the President to remove troops

  • 3. Right there is a clear violation of the separation of powers. The Constitution calls for no 'collective judgment', only a 'declaration' by the citizens representatives. The purpose of the Constitution is to delineate powers.

    As such the law is unconstitutional and those who passed it, and tolerate it, are all impeachable. Surely Wexler and his lawyers know this, and the fallout if it was pursued.
