  • another example is I have a minecraft ever and one rules is don't destroy over people work now that not a law and not illegal in the real world but it is on my sever it was dose to stop people destroying the place this is the same for youtube

  • if U brake youtube rules U can get in trouble dose not matter if it is not law eg you colud live on your own island that has no laws but your video can still be deleated and your channal can be remove becouse u proke there site rules

  • @Hi675445 No no no, lets get this clear for all, Youtube may indeed choose to delete or close an account for copyright infringements ... but ... all Youtube users can make counter claim this action with the weight of the law. Youtube is not a legislative body for copyright and has to respect copyright law when meting out punishment for what they deem copyright misdemeanour's. It doesn't matter if it break the t&c's of Youtube because they are stipulating law as the reason for cancellation.

  • Listen here Youtube can superseed copyright law because copyright law states that the its the owner of the copyrights right to fight any infringement in court. Now fair use is just that. If the Copyright Holders still feel that there work is being exploited they can then issue a statement to youtube to take down the material. If the infringer decides to counter that argument but the original owner wants to fight it in court then youtube has to take it down regardless of fair use

  • Just stumbled across this and what absolute twoddle. You should understand your subject matter before spouting unintelligible nonsense. Youtube terms and conditions cannot supersede copyright law because Youtube does not transcend Copyright law. Youtube is not a legislative body capable of banning people for fair usage material because they themselves would be subject to counter claims. Stop uploading this utter drivel and spamming up youtube.

  • @SiNapses77 Youtube is not a court room I am sick of trying to explain this to the thicky twins. Youtube will uphold any person that says the content is copyright. They give them a chance to review it and if they say it is still infringing their copyright the user is warned. Then the user must in 10 days go to court and file in real life a court documents saying that they are taking them to court on fair use. If they do not then it is upheld. Youtube asking for this to be sent to them

  • @SiNapses77 now you can think what you like. What I suggest you do is email youtube and ask them. Or go on their forums. I know this to be fact because unlike you and turd boy I am a partner and have access to all the partner forums. Basically simply stating that the material is fair use is no defence. It has to be proven in a court of law. Do you bloody understand. That means in real life with a real Judge. If the judge upholds it its fine. But only a Judge can say if it is fair use

  • @SiNapses77 and before you make yourself look like a bigger fool. Youtube has the right when you sign up this is specified. To ban anyone without any notice without any warning. They own the servers. Google pays for the servers. So basically they say what goes. If they feel you have broken their own terms of service they can ban you for life. Nothing to do with copyright law. It states in the TOS that you must use your own material. That is all they need to ban someone

  • But unlike Turdis I do not brag about people i have met. I could state I have met most of the cast at Longleat. I could state that I have a signed AUtograph by Ainley. I could state a lot of things. I touched the Peter Davison Original Console. I met Pat T. I could say a lot. But I don't. Now listen to me carefully I don't have to bother Turdis or you on anything I have made it and you can see my credentials on the banner. I have not seen any evidence Turdis is partnered with 2 entertain apart from what he actually says. I also make more views than him and have been around a lot longer than him. So basically he is no threat to me. But I do feel that copyright has to be addressed

  • Coincidently its been ages since I made this video I am moving on . I do not agree he is a true fan of Doctor Who I think there are a number now that are jumping on the band wagon simply because it is popular to be into it. Where as true fans have like yourself followed it over the years. True fans are also concerned about the direction the show is taking and the BBC losing interest as well. This video was done ages ago anyway

Whilst I do not necessarily agree with your assessment - I have no issue with young fans jumping on the bandwagon if it means they invest their time watching 'classic' who, the heart of the series - I can agree to disagree and leave it that.

  • Dude, you are missing the point of the MrTardisReviews reviews.

    He is often critizising the technical aspects of film making in an episode (usage of camera, lighting, the acting itself) etc. If you want to do that somewhat credible/convincing you also need to show what you mean. His review style differs in that respect from yours. You can downtalk it as much as you like ("just some student of filmmaking" or what did you call him?), but it's a perfectly legit way of doing a review.

  • @PsychoSebastian not missing any point. Again youtube is not a courtroom. It is not copyright law unless it is fought in court. Fair Use is just a guideline. Basically the copyright holders can still sue the person in court. It is not a criminal offence it is a cival offense. Therefore if Turdis decided to challenge say a take down notice and they refused to budge he would get a warning. He would then have submit to youtube in 10 days the Court Documents that he was challenging it.

  • @Aspergianstar2009 Well, the BBC is very protective of their Material. If they did consider MrTardisreviews as a copy right violation, they would have shut him off long ago. Report him to the BBC, if you feel they are missing him. The material used is property of the BBC afterall. And I still don't understand your whole point. Does one get a pot of gold or narcs for more subscriptions to one's channel? Or is it a mere ego thing? My "chan" is bigger stuff. I do not run a chan, so I'm just curious

  • @thelashers the BBC have told me that they allow Mrtardisreviews as he does not harm the brand. The min I can prove that he is making a single penny out of Doctor Who you will see what happens. At the moment if he is not making any money under fair use law he is not harming the brand of Doctor Who. But the min he does then he will be eligible to be taken to court and sued by the BBC.

  • Out of curiosity, what is your stance on AMVs? Neither the video nor the music belong to the uploader, however, the video in and of itself becomes new content with a new artistic vision.

  • I think adhering to this stupid (in my OPINION) copyright policy suppresses things such as freedom of speech, expression, and other freedoms. Who thinks that this copyright bullshit must stop and people should upload vids with songs whichever way they like as long as they give credit for the people who wrote the songs?

  • If there's anything I've learned from watching videos by thearchfiend, it's the fact that YouTube makes special exceptions for high level partners. I don't know what users you're specifically referencing, but if they are high up on the YouTube rankings, then YouTube will NEVER ban or suspend them. Why? YouTube loses money if they do. YouTube gets so much revenue from so many channels these days that it would be stupid for them to cancel their best money makers.

  • I really don't care about views yeah they are nice but I make videos for myself and for my friends because it is a great stress reliever I want my friends to see it but it doesn't matter about the others. If I ever get a partnership then it will be on another be I refuse to accept one with the videos I make now because it's true it isn't my material but I feel what I do is more like fanfiction than anything else but at the same time I understand the line between creative outlet and copyright

  • ...maybe that makes me somewhat of a hypocrite but I honestly don't care. I upload a variety of different videos, of different content. I know which type of video is popular on my channel, and I know which isn't. If you (as any kind of YouTuber) are on YouTube simply concerned with views/ subs/ friends, then you really shouldn't be on YouTube, simple as. YouTube is about creativity, and making tribute videos, releasing unreleased music is still creative.

  • Ok, I use copyright material, and dagnabit my channel is under threat constantly, but I don't make videos for views. I make them as a hobby. Back in the good old days on YT before the corporations got involved, you could upload anything you want and nobody would care. Then things like partnership turned up. I've been offered partnership on my videos twice, and both times i've denied it because its not right. It is somebody else's content...

  • @Trayusstudent1 that is not strictly true I lost a lot of channels because I uploaded copyright doctor who stuff. I always used to put them together and get good views such as 10k on one within a week. But someone flagged it or reported it and I lost my channel. I therefore think that youtube should tighten their policy as it gives an unfair advantage. However I respect your opinion to disagree with me that is your right and do not hold it against you

  • In my opinion, sometimes it's a great thing for one main reason. We live in a different generation, i was born in the early 80's. Now the kids, young adults of today who come here and watch a trailer or a video that has "copyright music" on it will think "you know that song sounds pretty awesome.." yet it's a song from like 20 years ago. If anything through Youtube we can keep generations of music alive and introduce it to people who haven't even heard of these groups before.

  • ...I've seen so many accounts come and go...I would see a pic, then one of those blank heads, I would click on it then the infamous message about the account violating copyright infringement or even community guide lines (which I guess the person was being a sociopath)....the rules need to apply the same to everyone....

  • THE RIAA is just pissed off that they aren't able to FUCK PEOPLE FOR MONEY ANYMORE. Therefore they go after large entities like Youtube. Frankly, I think artists would do better if people used their work in their videos. Afterall, there's plenty of artists WHO GET NO FUCKING PLAY AT ALL and NOONE'S EVER HEARD OF. When I put people's songs in my videos, some viewers get interested and ask where they can get the song.

  • You know what? My channel is too small to really be noticed, but even I have had a bit of a problem with copyright. I was notified that one of my videos was using copyrighted music; nothing happened to my channel, but I'm still scared my channel will be taken down. Why does it matter if we use music we bought in our videos? We're not letting other people buy it for free. If I put up pictures of Van Gogh's art, would it be reasonable for Youtube to take my channel down for copyright violations?

  • MrTARDISReviews may be using copyright clips but he is using it under fair use. He isn't editing the clips at all which makes it ok. Look, leave tardis alone, he has decided to ignore you and forget evrything but your still making fun of him but it isn't working. You will lose subs at this rate because people will be bored and tired of you bickering on about mrtardis all the time!

  • There has to be a multi-strike policy because a lot of YouTubers are totally uninformed. If a person gets 3 strikes, they're out. It dosn't take TOO long to accumulate 3 strikes if you're caught violating policy over and over again.

  • In my videos I have copyrighted issues on a few of them, the issue is flagged. however I've been warned once when I used Coldplay's new album music in a video and I've never had another one since. It depends on the level of music I believe and tracks. Some music is blocked and therefore so is the video.

    But I'm behind you 100%
