NO ONE would fire a .40 cal intentionally downward standing over someone against a hard surface. That would not be murder, that would be suicide! No one would mean to fire with that stance or grip. Google "Video proof that Mehserle thought he was firing his taser". When played slowly, you can see that Mehserle did not even have his left hand on his gun, when he fired recoil sent his hand towards his face. The grip safety should have prevented the gun from even being able to fire with that grip
