Whereas the job of the president is to simply pass or veto laws, the executive branch currenly also writes laws for up and down votes in Congress. As president, will you restore Congressional powers over the writing of legistation, budget, etc.?

    Senator Dodd: you've said many times that now-Chief Justice John Roberts promised he would never overturn precedent.

    I don't think he made any such promise, but more importantly, would you WANT a justice who would NEVER overturn precedent? Aren't there many notable precedents you're glad were overturned? Aren't there more you would like to someday be overturned?

  • Roberts said he believed in Stare decisis, which means "to stand by things decided". In other words he said he wouldn't attempt to overturn precedents.

  • rizzo, no. Yes, Roberts believes in stare decisis. So did the Supreme Court that overturned precedent in Brown v. Board of Education. Stare decisis is not an unbreakable rule, it is a principle. As Roberts said in his hearings, there are other principles, too, which might cause him to overturn a precedent. To say he promised to never overturn precedent is simply false.

    No justice would ever promise to never overturn precedent, and no Senator or President would ever want a justice who would.

  • Somehow, I don't think I used the word "promise". I also can't find where Dodd said that. Where did Dodd say that Roberts said he would "NEVER overturn precident"?

  • Dodd said that Roberts made "the statement that they will uphold precedent and they raise[d] their right hand before the Judiciary Committee and ma[d]e that committment, and then violate[d] that commitment," in the Nov 15 CNN debate. But Roberts made no committment. In Dodd's own speech approving of Roberts' nomination, Dodd even said "This is a delicate area, for the obvious reason that some precedents deserve to be overruled." But now he has changed his mind, apparently.

  • It seems that during the hearings he wanted definite answers about specific things, and whether or not they might be overturned. That Dodd believed that Roberts was promising in specific areas he would not overturn them, but then has.  Just a guess though. But you are right, it does sound like Dodd was saying that nothing should be overturned. However, remember that the q. leading to that answer was specifically about abortion rights, and his answer may have been only about that subject.

  • Dodd did not believe that, because Roberts never said it. On the contrary, Roberts explicitly stated he WOULD NOT SAY he would never overturn a precedent on something that was likely to come before the court, which obviously includes abortion-related cases.

  • I watched the hearings, but I don't pretend to have them memorized. I do remember Roberts saying he believes in Stare Decisis. In fact I remember him saying it while getting peppered with questions about Roe V. Wade. True, it doesn't mean he's promising anything, but don't you think it leads people on the committee to think that he is saying he wont overturn it?

  • In the context of Roe v Wade, during his hearings, Roberts responded, "... I think I should stay away from discussions of particular issues that are likely to come before the court again. And in the area of abortion, there are cases on the courts docket, of course. It is an issue that does come before the court. So while I'm happy to talk about stare decisis and the importance of precedent, I don't think I should get into the application of those principles in a particular area."

  • Roberts stated explicitly he WOULD NOT SAY he wouldn't overturn Roe v. Wade, or any other case that might come up before the court. Anyone listening to what he actually said, in full and in context, could not possibly be lead to think he was saying he wouldn't overturn Roe v. Wade.

  • If that were true, we wouldn't need judges. Because everyone would know exactly what the law is and there would be no gray areas. Nobody can say that "anyone listening" would come out of it hearing anything.

  • Roberts was entirely explicit. He absolutely and very clearly refused to say whether or not he would consider overturning Roe v. Wade, or any other abortion-related precedent. There is no sense whatsoever in anyone claiming he promised to not overturn it, nor in saying that people on the committee were lead to think he wouldn't, because he specifically said he wasn't saying that, and he gave no hints or suggestions that he *was* saying that.

  • Senator Dodd: you've said many times that John Roberts promised he would not overturn precedent. He never did, and on the contrary, he discussed in detail when it WOULD be appropriate to consider overturning a precedent.

    Further, NO Senator -- including you -- would ever WANT a justice to make such a promise. Ever hear of Brown v BoE?

    My question to you is simple: will you now take back your accusation against Chief Justice Roberts that he ever promised he would never overturn a precedent?

    With this kind of debt awaiting his graduation, I would like to know, if you were made president, would you push for socialized healthcare?

  • Again, his plan is on his website. It is not a socialized healthcare plan. It is a portable insurance plan using the same formula that they use for the Senate and Postal workers.  You also don't have to join it, you can stay with your current plan if you wish to.

    So in other words, it would be a huge nationwide insurance plan similar to UnitedHealthcare or Aetna, but without a profit margin.

    The questions asked stayed away from issues like Iran and making every candidate answer a question about their plan for the economy. Plus, if you havn't noticed Ron Pauls deep following on YouTube, and they played an anti-paul question First...
