A child cannot give consent to sexual intercourse, nor can a grown man assume that he can obtain such consent. It is against the law and against our conception of decency. By definition, what it was was not rape. Even the woman (13 at the time) had come out and said "he wasn't forceful or mean about it" and "I let him get it over with" in an A&E documentary.
Rape: 1. the unlawful compelling of a woman through physical FORCE or duress to have sexual intercourse.
2. any act of sexual intercourse that is FORCED upon a person.
Doesn't sound like rape to me. Just underage sex, which she seemed fine with at the time.

The court system involved in dealing with the military is not the civilian court, so it's an entirely different system to deal with. Anyone who rapes anyone should be brought to justice.
But as for Polanski's victim, she did say it was rape. She testified that she said no multiple times yet he did not stop. That is rape. Polanski admitted guilt and to my knowledge has never refuted his victim's testimony.
You seem intent in justifying the rape of a child.

Because the parents of the victim didn't want a long public trial, which would result in the publication of the victim's identity. It was in the interest of the child's well-being that there not be a public trial. Polanski agreed to plead guilty to the lesser charge.
It was an amazingly fortunate turn of events for Polanski. His maximum sentence allowed by law was going to be many, many years shorter because of this.

You are very ignorant of the way American courts work. By pleading to a lesser charge (which he was fortunate to be able to do) the victim's name would not have to be read in open court and thus wouldn't enter the public record.
Polanski admitted guilt to that charge, for which the maximum sentence is greatly reduced compared to what the prosecutor originally was going to charge him with.
I'll repeat: Polanski admitted guilt. He plead guilty, and he should serve the sentence for that offense.

The choice to let Polanski plead guilty to a lesser charge was the victim's parents'. They are her legal guardians and she was a minor. The court system doesn't let 13 year-olds make those decisions.
And again, when she said no and he didn't stop, that was rape. Nothing she may or may not have done before or after that (which no one has even provided evidence for, just baseless smearing) can change that.
Rape is rape. You're trying to say that it's OK to rape a 13 year-old? I would hope not.

It is also clear from the fact that all of you "worried" about rape etc. are unable to say a word about sexual molestation commited by American government and military on Iraqis. Polanski admited having voluntary sex with 13y old sexually extra experienced person, which is crime in USA (to compensate for largest porno industry), but is not crime in other count.

I do not condone rape under any circumstances. But what one person does in the seventies and what another does decades later somewhere else are separate offenses.
You don't judge one person based on the offenses of another. You take each case individually.
If all you can resort to are weak personal attacks, then you're basically admitting you have no foundation or valid argument for your initial argument that Polanski shouldn't be punished.

Even if that were true (I've never seen evidence of it) you'd have to prove that it wasn't consensual for such information to even be relevant, because the difference between consensual and rape is huge.
In the US, the age of consent is a state issue with few federal laws so most states have different laws regarding exact age limits, and even then there are age difference limits in most cases.
But in ALL states, if one party says no, and they get forced to do it anyway, it's rape. Period.

No matter how normal it was at the time, she was 13 and that is not an age where you can handle sexual romance and the consequences. If she was allowed around an 18 and had a relationship, it still has no bearing on Polanski did. She could have slept with a hundered men. Polanski still knowingly did what he did.
