But after the first half of the first serise he over steps the fine line between excutionor and murderer. That's when he becomes 'evil'. However, Death Note isn't a black and white anime. It's all different shdaes of grey instead. L, Near, Light, Misa, Mello they're all grey. None are innocent and none a truly evil.
