Gov Schwarzenegger agrees that Prop 8 is Unconstitutiional

what i cannot understand if the courts ruled that same-sex coupels had a constitutional right to get married, how could they then say the vote was valid, was it just the way it was presented in court, wouldnt the earlier ruling set a precedent?

Just as a factual aside, saying something MAY be unconstitutional does not mean one AGREES that something IS unconstitutional. Also, there's already been a court ruling on this matter once.
