  • Started off a bit shaky, but he turned out to be a great cop and a stand up guy all around. Very nice.

  • the problem i see here, is that the law is what the officer says it is, unless the citizen knows the law and is able to repeat it to the officer and prove him wrong. otherwise, the law is WHATEVER the officer CLAIMS it is. you can see here that the officer seemed very confident in his knowledge of the law and that he was willing to arrest them for audio recording. if they didnt know the law and he arrested them, would that be their fault? or his? just some things to think about.

  • @iamaronpaulblican You are correct to an extent. The lobby is open to the public, so it is considered a public place. Once you go past the doors beyond the lobby, then you must abide by their rules for that facility.

  • @1775novten uhm no, i am completely correct! do some investigation & you will see that all city and police "businesses" are private corporations, they are not here for & by the people anylonger, that ended a long time ago, they are privately owned & run (not something they like to advertise on the news) but if you ever wonder why when they do something bad noone gets punished unless it it a major stink, this is why, now i know this may seem hard for you to understand but this truely is the case

  • @iamaronpaulblican The bottom line is that the lobby is open to the public so there is no expectation of privacy in the lobby of a police station. Now I'm sure a department can say that they don't want people filming in their lobby and can force people out who don't follow those rules. But they can not be arrested for wiretap - at best they could be arrested for trespass if they refuse to leave.

The Lt in the video threatened to arrest them under the wiretap law and Adam explained to him that with the new ruling of Glik v Cunniffe that citizens were allowed to audio and video record agents of the government in the conduct of their jobs while in the public or publicly accessible areas.

  • @iamaronpaulblican I just went to my State's DMV manual and it states "Driving is a privilege, not a right." and "Whenever you drive, you must carry a valid driver’s license or learner’s permit with you."

    So you can claim to be sovereign and exempt, but the sad truth is that the government owns all the land and everything on it.

  • @iamaronpaulblican That is correct. A government has to power to order its agent to round people up and throw them into fire pits or gas chambers if they don't comply with their every demand. This has happened over and over through human history. However, most governments will appease their citizens with certain rights, so they will continue to work for them and earn them tax revenue to fund their military and police force.

  • He seems to be very professional.. I think he is a good cop from what I have seen. He at least took the time to see what the law was as recording him. Alot of cops would of gotten a big head and used there authority to do what they wanted to do

  • i understand why he said that he wasnt comfortable. however as an officer he should allowed to be recorded. Hs handled it well. he was a professional. but once he put that badge on he became a public servant, while he is in that uniform he has no privacy

I don't know of anyone who can't relate to that myself included. I would also like to say that anyone that wants to has a right to act like an asshole or pig, but no one has a right to make me act like one. That is a decision the individual has to make.

  • Was this honestly ever a question? Putting camera's in people's faces and instantly acting like you know every law to the T and want to argue doesn't help any case. Treat one like you want to be treated. The asshat in the beggining spouting off Appeals court and threatening lawsuit doesn't help your case. Also threatening to "deal with it at a department level" is a joke, you are in no control how they deal with it. Once your report is filed, they determine how to move on.

  • To clarify my last comment, I don't mean that he doesn't in fact follow their own laws (as best as he knows) but rather it is concerning that he wouldn't even understand that not all cops do always follow the law, and that is the reason you wanted to record. It isn't an attack on him, he seemed like a pretty decent officer, but simply understanding that not all officers are is important.

  • I would say he acted professional, except for his two comments that made it clear he didn't care to serve, but viewed you guys as criminal "That's a risk I'm willing to take" in response to him potentially violating the law. I'm glad he thought better of it and looked it up. The second was "we do not break our own laws, I don't understand why this would even be necessary [to record]". Laughable. Let's just take your word when it is ON film others NOT following the law. THAT is why people record.

  • There is no such expectation that it is not being intercepted, as it is done openly and he was notified, so no additional court ruling should have been necessary. It is sad that it had to be it.

  • Not only have the courts ruled you can audio record, on many occasions, but even based on NH law (RSA 570 A-1) you can record in public openly, as the only communication subject to the wiretapping law are oral communication, and telecommunications. This is obviously not telecommunication, and oral communication is defined as " communication uttered by a person exhibiting an expectation that such communication is not subject to interception under circumstances justifying such expectation."

  • Lol, I would like you to stop audio recording me so I can take you in a private room and secretly audio record your complaint. Police audio record people all the time when in custody or with cameras on squad cars. This is about control and domination never forget that.

  • The officer is using anything he can to prevent the recording.Officers at times take various complaints in the field where it is legal to record.Officers record audio and video with equipment that is in their cars mounted in the station and portable devices that some use while questioning people and in some cases being recorded in a courtroom which is also a public forum.My point is I don't understand why the lieutenant does not feel comfortable being recorded.

  • From what I can tell, he is a good cop. With a rogue government like we have today, it would be impossible to ALWAYS know every new regulation without first being informed. Cops are people too, and usually I say that because cops are being assholes and abusing their authority- but in this case, it is in defense of the officer. Once he learned of the new policy, he responded professionally. The precinct itself has rules he has to follow, UNTIL they are changed. Good cop, on the evidence.

  • The cop was in the wrong by threatening them with arrest, certainly, but once he understood that his position was incorrect, he showed appropriate contrition. I have to admit that given the situation--the dereliction of duty among officers--the recording of the event really does make sense. That said, it's a shame on the part of the police department that they did not let him videotape the complaint in the name of transparency.

  • I am not from America and I have no connection with America, however, I do follow what is happening in the world (in a big part, America) and I have to say, this cop acted in a very professional manner. He did everything he could within the limits of his profession. I take my hat off to the guy.

  • I can see why being taped might be threatening because its easy for people manipulate the situation or later manipulate a recording to make the officer look bad. Cops will gradually become attuned that in this daybn age citizens can hold them accountable like never before and will help diminish abuses of power n police brutality, and will become even better public servants.

    This is an example of power versus the perceived weaklings. At these rallies, Ron Paul supporters should have a point-man and a cameraman who are flanked by two big security guys to counter whatever muscle comes their way. I'd have the security guys dressed in suits with laminated badges that says SECURITY. Having some muscle would deter assaults and force the opposition to politely ask Paul supporters to step back.

Sure, if I were to push a security officer he would probably attack and detain me, but that man didn't push Adam from what I saw, he simply grabbed his shoulder and maybe forcefully steered him in a particular direction. Rude? Very yes. An assault worthy of reporting to the police station? I personally don't think so. I'm open to argument, I welcome it actually it's just that at this point I find it silly

    Many of the laws have become so complicated, that police officers depend on the SA to sort out cases. Its an issue that starts with the legislation.

They even show appreciation and compliment the guy, and apologize for themselves. It's not like they're out to bully good cops, but rather expose derelict officers. The quote "who watches the watchers" comes to mind. Someone has to police the police, and it shouldn't be the police themselves.

He is required to identify himself, show official ID (although they wear name tags to avoid haring to produce the ID), and have his badge number visible at all times. He can not conceal his identity while on duty.

  • The internal offices are still PUBLIC. The cops are AT WORK AS PUBLIC SERVANTS. He interprets the law incorrectly. There is no expectation of privacy when they are performing official duties. I understand wanting to get the complaint in and it was obvious the cops budged as much as they were willing. Maybe they will learn and understand better. The officer was professional and I applaud that. Hopefully, he can understand the law better. But above average for a police officer. Thanks officer.

  • He appeared to be an honest cop following steps and procedures. What impressed me was his level of cooperation. In my experience it's difficult to engage in any conversation or even argue a point. My bias is not in favor of police but This one is setting a good example and I am pleased.

  • @djgrooveline Judges interpret the law. Police enforce it but are often ignorant of it. Cops are taught very little about it and their superiors almost never tell them of changes to legal precedent that affect what they can and can't do. Police in the U.S. receive almost no training compared to most other western countries. Some places require 2 years of training. The U.S. requires only a month or two in many places.

  • I think he is one of the good cops honestly. I have been critical of the bad behavior by cops with Occupy protestors, but this Lt. is actually having a dialogue respectfully, and even double checks the laws in this case. I wish we saw more cops like him in the big cities like NY and LA where they instead abused power. I'd be glad to have this officer in my town.
