Prop 8 was either bigotry cleverly disguised or it was a sincere effort by religious to protect traditional marriage. Let's give the religious people who paid for and supported the "Yes on 8" vote the benefit of the doubt. We have accepted the Prop 8 reality that a majority can take a right away from a minority in spite of the equal protection of the laws. I think that gay marriage should be legalised but that's a separate issue, but banning divorce isn't correct either. I hate divorce I wish it never existed but what about the women who get married to a man who promises to protect her all her life who starts physically and emotionally abusing her? Does allowing the kids stay in that house help the kids in anyway? you can find evidence for physical abuse but what about emotional abuse?

The marriage of two people of the same sex isn't a marriage.
Marriage is about more than just love. It is also about the joining of two family trees into one. This is why so many of the rights and benefits of marriage are linked to procreation - the right to be presumed the father of your wife's child goes with an obligation.
Gays want the rights but not the obligations
There is no "right" to be recognized as father to a child that isn't yours.

That means a man has the right to be presumed the father of his wife's child; if they were not married they would have to go in front of a judge to get the same legal recognition
That right - & all the other rights that are meant to enable the breadwinner to support the caregiver as they raise a family - are procreative.
Gays should share those rights with their baby-mama, nobody else.

Anyone who can't tell the difference between their needs vs. their child's - anyone who can't recognize that their child's needs might be in conflict with theirs - is not ready to be a parent.
Being motherless or fatherless is not harmless. Kids need to grieve the loss openly.

It's recognized in all 50 states (though maybe one really good law at the federal level would put this nonsense to rest once and for all).
It's also recognized by a host of experts and studies.
Check out the book Motherless Daughters, or any one of the excellent books on the effects of fatherlessness.
Those studies are IMO much more credible than the biased GIGO studies demonstrating how lesbians who know they're being watched raise "perfect" kids.

@birdablaze I would be down with outlawing adultery if people are going to be deliberately committing adultery so that they can make a baby with someone outside the marriage, then use the presumption of marriage to "give" the baby to someone other than the child's real father. That's fraud, and when it's done to collect benefits that aren't rightfully yours, it should be a felony.

The two partners are equally less as risk for "explotation" and so are the children that they either bring in to this world or adopt from extremely unfortunate situations where they ARE at risk. Please explain how prohibiting divorce protects children. One effect, you see, of the prohibition of divorce would be locking people in abusive marriages -- and the children get locked in right with the abused spouse. I fail to see how forcing a child to stay in a home where one parent beats the tar out of the other, or rapes the other in front of the children, or uses drugs in front of the children, is "protecting children". I am against marriage period! I support homosexual marriages because hey they want the same glamour and whatever is so beautiful about marriage and hey as long as it is two consenting adults and no children, or animal or dead bodies then I am fine with it. I don't believe in the sanctity of marriage.

Prop 8 was either bigotry cleverly disguised or it was a sincere effort by religious to protect traditional marriage. Let's give the religious people who paid for and supported the "Yes on 8" vote the benefit of the doubt. Say they were sincere, then they should be equally sincere in outtlawing divorce to protect traditional marriage. And they should pass a law only allowing marriage for the sole purpose of procreation. That way folks wouldn't get married just to have legal recreational sex.

We have accepted the Prop 8 reality that a majority can take a right away from a minority in spite of the equal protection of the laws. The justification was "the sanctity of marriage" trumps individual freedom. So the same must be true for divorce, right? Divorce rights can be taken away in the same way marriage rights were. I know it stinks but that is how it is folks.

If children are involved, divorce should be MUCH more difficult to attain. No-Fault laws that went in the effect in the '70's have had drastic consequences to our children, period. Marriage has become nothing more than a convenience, not a commitment, so with what has transpired in America in the past 30 years, why not allow marriage to goats too? Does marriage actually mean anything anymore, other than getting health benefits from the spouse and tax breaks?
