Could a compromise be reached with progressives and libertarians by putting Bureaucracies in an advisory role?

This would allow the FDA to put out toothless recommendations that could be used against a defendant in a court if it's found that harm was created because of not following recommendations. But thats it. no preemptive raids, no pre-crime enforcement.
